H-1B Visa cap reached in five days for fourth consecutive year

U.S. Citizenship and Immigration Services (USCIS) announced on April 7 that the H-1B cap for fiscal year 2017 was reached—meaning that in five business days, U.S. employers filed more petitions for an H-1B visa to hire a skilled foreign worker than the entire year’s allocation of visas available under current law. This means that USCIS will conduct a lottery to determine which employers will get the visas they need.

Every year, U.S. employers seeking highly-skilled foreign professionals submit their applications for the pool of H-1B visas beginning on April 1 each year. U.S. businesses use the H-1B program to employ foreign workers in occupations that require highly specialized knowledge in fields such as science, engineering and computer programming.

Congress has set a limit of 65,000 visas for new hires, and 20,000 additional visas for foreign professionals who graduate with a Master’s or Doctorate from a U.S. university. Current H-1B workers who have been counted previously against the cap are not counted toward the cap. In recent years, demand for H-1B visas has outstripped the supply and the cap has been quickly reached. In FY 2015, more than 230,000 petitions were received. This leaves some employers with no ability to access the workers they have determined they need. This year is no exception. USCIS also noted that it received more than the limit of 20,000 H-1B petitions filed under the U.S. advanced degree exemption.

The H-1B lottery will randomly select 65,000 visas for the general category and 20,000 for the advanced degree category from among the petitions submitted. Employers who are not selected in the lottery will have to wait until the next fiscal year to submit new petitions. The uncertainty employers face because they don’t know whether or not they will be able to hire the workers they want can be difficult.

USCIS also noted they will continue to accept and process petitions that are otherwise exempt from the cap including:

• Extend the amount of time a current H-1B worker may remain in the United States;

• Change the terms of employment for current H-1B workers;

• Allow current H-1B workers to change employers; and

• Allow current H-1B workers to work concurrently in a second H-1B position.

Once again, the exhaustion of the yearly H-1B cap in a matter of days shows that our immigration laws and policies are out of touch with business and economic demands. Policymakers must recognize that the H-1B and other temporary nonimmigrant visa programs play an important role in growing and innovating the U.S. economy, and enabling U.S. businesses to compete for global talent.

Mandate that H1B visa holders be paid twice what their supervisor is paid.

We’re always told how valuable they are, so they’d be cheap even at that price, right?

Might cut the demand a bit.

The uncertainty employers face because they don’t know whether or not they will be able to hire the workers they want can be difficult.

Here's an idea.

Be willing to pay the normal going rate for the task you need done, and be willing to accept the idea that the American you hire might need a month to get the hang of what you want him (or her) to do.

Then you'd have the workers you need, and you also don't have to worry about a visa expiring.

There are approximately 4,140 colleges and universities in the U.S. (including 2 year colleges). Each has a college of some form of technology. With just 15 per graduating class, that's 62,100 graduates per year.

Do we really think we need 65,000 H-1B's? Heck no. It's just another way to decrease costs at these companies, because we've opened the door to allow it.

Then, the college grads get all bent out of shape because they have all this student debt and can't get a job. So they do something really stupid, like vote for Bernie.

The going normal rate includes not only the salary but Healthcare ( which must meet Obamacare mandate requirements ), Payroll taxes, labor regulatory requirements, etc.

That would mean that there are lots of jobs available at lots of companies.

Wonder when those positions will be offered to the general public?

Suspend the issuance of all H-1B visas for 180 days to complete a comprehensive investigation and audit of pervasive allegations of abuse of the program: Initiate an immediate 180-day investigation and audit of the H-1B visa program and enact fundamental reforms of this program to ensure that it protects American workers.

In recent months, more and more reports have become public of companies replacing American workers with cheaper foreign workers, contrary to the stated intent of the H-1B visa program. This will stop, and the H1-B program will be suspended until we can be certain that the program is no longer being abused.

Enforce existing federal protections for American workers: Conduct systematic audits of the companies that have taken advantage of the H-1B visa program during the last 15 years. All companies that have violated the terms of the H-1B visa program will be barred from using it for a period of years. The Attorney General will have authority to prosecute any individual found to have committed H-1B visa fraud, and offending companies will be suspended from receiving government grants and contracts.

Amend the H-1B visa program to fulfill its original purpose: Work with Congress to pass reform legislation for the H-1B visa program that will:

Create an advanced degree requirement: Only individuals with advanced degrees in their respective fields may be brought to the United States with an H-1B visa. And preference will be given to those with advanced degrees from American universities.

Create a “layoff cool-off” period for all H-1B visa applications: Companies must wait one or two years between laying off a worker and bringing in any H-1B foreign workers to ensure that the program is not used to displace American workers.

Establish accreditation or recognition requirements for overseas schools: The recent lack of federal oversight of the H-1B visa program has fueled a cottage industry of diploma mills. Foreign academic institutions must meet minimum accreditation standards at least as stringent as those imposed on American universities in order to qualify for the advanced-degree requirement.

Require sworn affidavits describing domestic hiring efforts: Companies will provide sworn statements and documentation that detail their efforts to hire Americans before requesting foreign workers through the H-1B visa program. Individuals who make false statements in these affidavits will be subject to perjury charges.

Suspend companies from H-1B visa eligibility for failure to help foreign workers obtain green cards: Many companies misuse the H-1B visa program to train foreign workers that they intend to send back overseas to compete with America. The law must impose additional requirements on employers to pursue Legal Permanent Resident status on behalf of their H-1B visa-based foreign workers, or risk loss of access to the program.
