Hillary Clinton: ‘The Unborn Person Doesn’t Have Constitutional Rights’

Former Secretary of State Hillary Clinton said on NBC’s “Meet the Press today that “the unborn person doesn’t have constitutional rights.”

Clinton made the statement in response to a question from “Meet the Press” host Chuck Todd. Clinton also said that an unborn child’s constitutional rights are “not something that exists.”

Todd asked: “When, or if, does an unborn child have constitutional rights?”

“Well, under our laws, currently, that is not something that exists,” said Clinton. “The unborn person doesn’t have constitutional rights. Now that doesn`t mean that we don’t do everything we possibly can in the vast majority of instances to, you know, help a mother who is carrying a child and wants to make sure that child will be healthy, to have appropriate medical support.

“It doesn’t mean that you don’t do everything possible to try to fulfill your obligations, but it does not include sacrificing the woman’s right to make decisions,” Clinton continued. “And I think that’s an important distinction that under Roe v. Wade we’ve had enshrined under our Constitution.”

I didn't know this until yesterday when some learned FReeper posted about Justice Blackmun's comments from Roe vs. Wade oral arguments. The following is quoted from crusadeforlife.org

Much has been written over the years concerning pro-life vs. abortion; however, personhood has always been the central issue. If the preborn is a fellow person then he or she is entitled to all of the protection of our laws in the same way as any other person. This was clearly understood by Supreme Court Justice Harry Blackmun as can be seen by the following statement he made during the hearing of Roe v. Wade.

“If this suggestion of personhood is established, the appellant’s case, of course, collapses, for the fetus’ right to life would then be guaranteed specifically by the Amendment.”

I hate to break it to you but that’s always been the law in the US. It was the law at the time the constitution was adopted. They passed a law in a number of states prohibiting abortion but that did not alter the definition of a person.

The appellee and certain amici argue that the fetus is a "person" within the language and meaning of the Fourteenth Amendment. In support of this, they outline at length and in detail the well known facts of fetal development. If this suggestion of personhood is established, the appellant's case, of course, collapses, [p157] for the fetus' right to life would then be guaranteed specifically by the Amendment. The appellant conceded as much on reargument.

A simple, uncomplicated truth: at the moment of conception, a unique, precious and innocent life begins. The smartest woman in the world should be able to comprehend that fact.

Children are unborn right up until they are born. Is Hillary indicating that abortion is a-okay up through the third trimester?

So if you wanna REALLY force her into the corner, the eventual nominee asks one simple question: What rights DOES an unborn person have?
Watch her have another coughing attack while she tries not to give the answer she REALLY wants to give.
She would be forced into an absolute no-win situation with this question.

Great quote. Well, there is precedent for the government of various states treating by law the unborn as people. In the state of California, Scott Peterson qualified for the death penalty BECAUSE OF THE SPECIAL CIRCUMSTANCE OF DOUBLE HOMICIDE. He killed his wife Lacey in cold blood, and she was in her second trimester with their son, Conor.
The state considered him a person or Scott wouldn’t be on Death Row.
