This is Florida. While they have good self-defense laws on the books, it’s still gonna be tough to claim self defense if the perp was fleeing at the time.
I’m just basing this on the many articles and trial coverage that I’ve read on the subject at legalinsurrection.com. Andrew Branca is a lawyer that covers these issues there and is a self defense expert.
I expect him to have a piece on this one in the next few days. There’s going to be more facts coming out about this that will maybe give a clearer picture.
The police haven’t released details and haven’t arrested the shooter, so we only have the articles’ word and that of the relatives that the burglar was fleeing when he was shot dead!
