Is it true what someone on Fox said that the Senate will have to be adjourned for 2 weeks next January in which case Obama would be free and clear to do a recess appointment? If so we may be stuck.

Even if Obama did that a week or so before leaving office, I believe the Senate has to approve/disapprove his nomination or appointment. The liberal socialist, islamist or communist nominee would be quickly removed.

Senate Minority Leader Harry Reid (D-Nev.) quickly fired back saying that "it would be unprecedented in recent history for the Supreme Court to go a year with a vacant seat."

Unprecedented is the perversion that Valerie and Hussein have crammed down the throats of the people over the last seven years.

Scalia must be replaced with a Constitutionalist, not a Communist.

Perhaps, but I don’t think too many of those are contested.

Additionally, I think the mood of America is that it is tired of Obama’s shenanigans.

I don’t think the “victim” crap will get much traction.

Why not let Obama select someone - exhibit what a commie traitor they are in the hearings - and then vote them down and say "next".

Thank you for a voice of sanity. Despite the daily cries here for a return to Constitutional principles now is the time to demonstrate them rather than engage in hysteria.

First, let's take a breath and show some respect for the passing of a great American. It's less than 24 hours since the news of Scalia's death and this is already a Wellstone funeral here.

Second, Obama will certainly nominate a replacement, as is his constitutional prerogative and duty. Trying to be openly obstructionist about this will only backfire and be used against the Republicans in the Fall, raising the likelihood of a majority control change in the Senate.

Third, it then devolves on the Senate to do their constitutional duty to give the nominee a thorough hearing and vote. Investigate thoroughly and deliberately and use the "teaching moment" effectively.

Fourth, remember that no one is indispensable. The balance of the court is always dynamic and the justices are people, not robots whose decisions are pre-programmed. Remember that Obama has seen a record number of 9-0 decisions against him during his term despite his appointments. If the Senate does its job we have nothing to fear.

The next president will likely have opportunity to fill vacancies as well. The whole purpose of a Constitutional Republic is to provide levels of indirection (checks and balances) to prevent momentary passions from having undue influence on the course of the nation. Those who want to hew to the Constitution only when convenient are no different than those who want to disregard it altogether. We're better than that. Use the process.

When I first heard of his death the first thing I said was “They killed him” and I do not think I am paranoid. I think the timing is suspect. It has not even been 24 hrs since his death and Obama and the democrats are already choosing his successor. And the sad news about Mr. Scalia comes just about one day or say after the Supreme Court put a stay on Obamas Epa shenanigans.

Please. Scalia was almost 80 and overweight. He lived past his life expectancy. My worry is that Thomas may be right behind him.

The process of nominating - debating - voting down - however many candidates are nominated should last long enough for the next POTUS to decide


I think GOP Senators may be willing to reject the Obama Court nominee once...But, not twice...Political pressure will be too intense for them...

Remember Robert Bork? Senate, controlled by Dems, did not confirm him...However, Reagan’s second choice was confirmed. His name was Anthony Kennedy.

Look, unfortunately, Obama is going to appoint someone to the Court...After all, Dems eventually let Reagan appoint Kennedy to the Court...

I agree with you that GOP Senators will end up holding hearings on Obama nominee....

I agree that next president will have chances to fill vacancies...You cannot really predict what is going to happen to Justices...I never heard anything about Scalia having health problems...Did anyone predict Thurgood Marshall to retire from Court in 1991 during Bush’s term?

Congress can change the number of justices on the Supreme Court without a Constitutional amendment. They did it several times in the 1800’s. Maybe it’s time they at least doubled the Court to 18. With more members, it wouldn’t be so dependent on one member to tip it this way or that.

They will not wait an entire Year to replace Scalia. There will be a new Justice seated by the time Summer rolls around, count on it.

McConnell’s bluster will be short lived. I’m waiting to Linda Gramnesty to lead the fight.

Obama has Judges that received Unanimous Support in the GOP Senate when they were given their current Federal Judgeships.

How can anyone say no to them when it comes to the SCOTUS when they did nothing to stop them from attaining a lower Court Judgeships?

Republicans are incapable of playing the long game, and they will look like the Morons they are trying to stand up against someone they backed wholeheartedly a scant few years ago.

Sorry folks, if the Senate doesn’t act it will just be something the DemoncRats can pound them over the head with in the coming Election. Party over Country will be the siren call.

You won’t even need a big Tub of Popcorn watching the Confirmation Hearings. hey will be over and done at Warp Speed, just like the ones for the Wise Latina and the other Lesbian.
