I believe, theoretically, that Obama could appoint a vacancy SC justice during a Senate recess. The appointment would stand until the end of the current Senate. He has shown before that he is willing to make moves like this. Nothing these people do surprises me anymore.
Jan isn’t a recess, it’s an adjournment. I think there’s a difference.
