And Obamacare is not a tax, but it IS, per USSC CJ Roberts’ edict....

That wasn't about whether or not people had to pay. It was simply about what to call it. That tax/penalty was contained in the statute. This "fee" to build a wall has no statutory basis at all.

My point is that ‘law’, authority, and application are whatever those in power say it is. There are plenty of legal beagles that can figure out the mechanics.

No, the law is whatever the Supreme Court says it is, not whatever the President says it is. Did you notice that just yesterday, the Supreme Court tossed out Obama's carbon emission regs? Probably not would be my guess....

Okay, did you at least notice that the courts have stopped enforcement of Obama's most recent attempt to do an end run around the immigration laws? Stopped it dead in its tracks.

So the assumption by so many here that Trump can just wave his hands to implement the stuff he wants his wrong. The same SCOTUS that has stopped some of Obama's stuff will take about half a second to affirm a lower court ruling striking down these fees and stuff that lack any statutory basis.

Despite a lot of popular misconceptions, "legal beagles" can't simply invent "mechanics" to overcome Court objections. Though it obviously makes a lot of folks feel good to imagine they can. That "fee" idea is a 9-0 loser at SCOTUS.

2nd pass draconian laws on American business to hiring illegals and people using fake SSNs....3rd tax remittances to Mexico 75%. Pass draconian laws seizing all assets of companies that use 3rd countries to wire money to Mexico.

In what universe does a Congress populated overwhelming by what Trump supporters refer to as "the Uniparty" pass those laws? Heck, even if you forget the filibuster, there's at least a 50-50 shot that the Dems end up controlling the Senate.

And even if you forget the Senate, isn't the consensus here that 90% of Republicans in Congress are liberal RINOs, led by the traitorous Paul Ryan?

That stuff has absolutely zero chance of passing.

Zero.

Great campaign sound byte rhetoric like all else Trump.

How will Trump force Mexico to pay? That answer is ‘he won’t’.

Impose high tariffs on imports? Hold wetbacks hostage for ramsom?

If Trump actually does anything to ‘make’ Mexico pay, within 6 months there will be Russian or Chinese Mil bases sprouting up like flies in a Mexican meat market.

Like everything else Trump, ‘Mexico Will Pay’ is just more BS for the lemmings.

Did they stop the tax on asset and title transfers, medical device taxes, fines/fees and assessments on not having a 'qualified plan'? All the added costs of government imposed HIPAA? No. You don't realize that 'ruling' against isn't 'stopping'. It hasn't been for 7 years. Just go on off and live in your world of make believe.

They didn't stop the medical device tax because it was cexplicitly stated in the statute itself. You're talking about Trump inventing and implementing a tax that has no statutory basis at all.

And, the second part of Oba's amnesty is stopped - documents are not being issued. And, the carbon regs are also stopped - the Order stopped the accrual of all fines/fees.

You don't know what you're talking about. The claims by Trump opponents that he's going to be a dictator, and all the claims by Trump supporters that he's going to be able to do whatever he wants just by executive order or force of personality, are equally wrong.

The courts will just strike it down either way. They certainly don't strike down every slimy move Obama has made, but that's because Obama has gotten pretty good legl guidance so that they're just skirting the law in many cases. But most of the stuff Trump is proposing isn't even close to the line.

Like it or not, Trump is going to need the active cooperation of a Congress you detest to get anything substantive on his agenda enacted.

I'll tell you what really worries me about the Donald. He's making all these promises that will require Congressional action, and Congress won't be favorably disposed. But, he keeps talking about his legendary ability to make a deal. So, here's my concern:

What exactly is he going to be giving Democrats that will induce them to give him what he has promised?

You keep pointing to some things that haven't been stopped as proof that nothing has been stopped.

A turnip could see the flaw in that logic.

The other thing is that you repeatedly confuse Obama choosing not to enforce existing laws, with inventing new ones. Those are two completely different things because the first runs into the knotty issue of prosecutorial discretion, to which courts have historically deferred.

I also am amazed at your assumption that a Court that you believe bends over backwards for Obama will do the same for Trump. What makes you believe that?

I do not have that ‘respect’. That court's bleats are only as powerful as those willing to back it up. We have been shown by a quisling Congress that it won't do a damned thing because they like their second-tier power..

Enforcing laws and prosecutorial discretion? Really? Tell me about Hillary Secretary of State Clinton's emails. Tell me about laws and prosecutorial discretion. I know I've signed many an affidavit and oath about classified information handling in my adult life with severe penalties threatened. Where are those for her?

Don't stand on grandiose ideas when we are confronted with the realities of evil. Otherwise, some day in the future our progeny may actually become the Yangs vs. the Coms in some distant future.

Does anyone here really know what has to happen for Mexico to build the wall? Trump can’t just sign an Executive Order. I’m sure Congress has to get involved in some way. If it’s $8 billion I’d rather hear him say the US will pay for the wall with money deducted from the sanctuary cities!

Operation Wetback was great. But that basically involved moving buses to work camps, loading people up, and shipping them out. Today, they're all dispersed, there are legal issues, etc.

I'm a big fan of boosting e-verify and increasing employer fines. Statutorily waive corporate limited liability for individuals who hire illegals. If they can't work.... Although someone prominent currently running for President called that "mean-spirited", so it probably won't happen.

I think it would be cheaper just to mine the southern border. Nobody quite knows where they are and after a few bad guys get blown up, they’ll stop crossing. (Oh, darn, I forgot about the rabbits and deer, so sorry!).
