Sorry, you are wrong. The privately owned Keystone Pipeline would be a “public utility” ( https://en.wikipedia.org/wiki/Public_utility ) just as your local privately owned Gas & Electric company is a public utility with their services available for PUBLIC USE. Such privately owned public utilities have been (correctly) empowered to use eminent domain for well over a century.
The degree of ignorance among Americans continues to grow IMHO.
In some states, not all, the owners applied for a certificate to allow the use of eminent domain to acquire property regulated by the state public services commissions or whatever they are called in various states. This allow them to not have to get approval for every acquisition of land for the project. That does not mean the pipeline is regulated for cost, price etc like a public utility would be governed.
The Philadelphia and Lancaster Turnpike, begun in 1792 was a privately owned road... the first railroads were privately owned and folks were forced to sell their land for construction.
So, the pipeline is about private companies, managed by a commission, that controls rates is still a private business. Any business that hangs out a shingle is open for 'public use' in those contexts. It is not my degree of ignorance at play, it is your scrounging to try and mix wordage.
Once again I submit most eminent domain is used for redevelopment of older distressed areas for upscale development that increases the tax base.
It goes to private refineries, House.,Phillips Petroleum and others. It’s using eminent domain to benefit huge corporation. There’s really no getting around that.
