WI: Governor Walker Signs Constitutional Carry for Knives

Knife Rights and Wisconsin Force worked together to pass a significant reform of antiquated knife laws in Wisconsin.  Wisconsin knife laws date back to the muckraker days, when the media was able to pass nonsensical laws based on "trendy", "progressive", emotional notions rather than on common sense, or any consideration for the the Constitution.  Wisconsin’s silly and dangerous switchblade ban dates to 1956.  It has been used to fine, convict and incarcerate hundreds, if not thousands of people who were only exercising their Second Amendment rights.

In 1998, Wisconsin finally finished the arduous process to pass a right to keep and bear arms amendment to the Wisconsin Constitution.  It ended any argument about weather the Second Amendment applied to Wisconsin. From Article I Section 25:

 The people have the right to keep and bear arms for security, defense, hunting, recreation or any other lawful purpose.

It is hard to see how a ban on the carry of knives, which are clearly "arms" could withstand any serious consideration in a Wisconsin Court.  An appeals court in Wisconsin recently confirmed that knives are arms protected under the Constitution.

Votes for the bill were uncontroversial.  It passed with unanimous voice vote in the Senate, after passing the Assembly in October of 2015 with one dissenting vote.

As more people are bearing arms, violent crime has been going down.  Violent crime has dropped by half since 1993; the number of people with firearms permits has increased by more than 1,000 percent in that period.  Wisconsin was the next to last state to enact a law reforming their concealed carry law, in 2010.

People who may legally posses firearms will have the right to carry knives concealed.  Otherwise there will be almost no restrictions on the carry

Knives are arms protected by federal and state constitutions. The bans on the carry of knives have been used to fine, jail and imprison hundreds of thousands of people in the United States. In the last decade alone, over 40 thousand have been victimized in New York City alone.

I think you mean, victimized by the State, using a knife law.

Carrying his knife was definitely illegal in New York City.

People who are prohibited from carrying firearms are prohibited from carry concealed and switchblades knifes looks like to me

As I read it, if you are carrying the knife openly, even if you are not able to legally possess a firearm, it is legal.

So it looks like carrying a knife openly would be legal for someone who had a felony record.

I am not a lawyer, nor do I play one on the Internet.

Until it comes to passing through the smoke and mirror zone prior to reaching the boarding gate for your next airline flight.

Allowing convicted felons who have paid their debt to society to have guns should be the next area of law to be changed. Any restriction on “shall not be infringed” only energizes those opposed to gun rights of any kind.

It’s a little more complicated than that.

While a federal lifetime gun ban exists, some states offer a restoration of gun rights by a judge, based on:

They must be non-violent offenders who did not use weapons in the commission of their crimes, nor do they come under the blanket of “domestic violence”, nor be adjudged to be mentally ill, with the older standard of “representing a threat of harm to themselves or others”, or who are reliant on psychotropic drugs, or addiction to illegal drugs or alcohol.

There is a lot of gray area there, so the judge has considerable discretion. It is perhaps most often refused because of gang ties or involvement with violent criminal conspiracies, behavior in prison or expression of threats against others.

Importantly, ex-cons see the restoration of gun rights as by far the most important of the rights they have lost, since they are frequently victims, so many will go through the hassle for restoration.

I have a little 2.5” folding knife I carry daily. Is that illegal in NYC?

I know my 9” combat Bowie is, but it’s illegal to carry almost everywhere.

It depends. Can a police officer, who trains extensively to so, with many different types of knives, open your knife one handed?

If so, you would be guilty of illegally possessing a “gravity knife” according to the NYC DA. He has extorted hundreds of thousands of dollars for his personal office “knife safety” slush fund doing this for the past several years.

People with knives of blade length as small as 1 inch have been arrested and prosecuted. Even the Village Voice came out for a reform of this law.

The ONLY ‘complication’ is the utter B.S. that you posted (no offense to you, I meant the process).

Either one is a con, which should still be in jail, or a Free man.

To have a Free man ‘lawfully’, even temporarily, denied their Rights, creates a caste/2nd-class citizen.

It is wrong. Period.

Is that the main criteria? The knife I have can be opened one-handed, but you have to flick it pretty hard with your wrist.

It's a Spyderco knife with the large opening on the blade to push it open with.

I have no plans (EVER) to go to NYC, so this is mainly an academic discussion.

Then according to Cyrus Vance, the NYC DA, it is a gravity knife.
