Ted Cruz Is A 'Natural Born Citizen,' Board (Illinois) Of Election Finds

On the same day he won the Republican Iowa caucus, Sen. Ted Cruz of Texas got a favorable decision from the Illinois Board of Elections, which ruled that he met the citizenship criteria to appear on the state's primary ballot.

Two objectors, Lawrence Joyce and William Graham, had challenged Cruz's presidential bid with the board, contending that his name should not appear on the March 15 ballot because his candidacy did not comply with Article II of the Constitution.

In response to the filings, Cruz's lawyers relied on Supreme Court precedent, legal history and articles from noted constitutional scholars to defend the view that he is in fact "natural born" within the meaning in the Constitution.

Right Trumpsters?

Perhaps Trump was a little right here in calling out Cruz to take action and get some decisions from people that actually matter.

This should blunt any efforts by the devil's spawn (Clinton) to make an issue of this later.

Now, maybe Trump can focus on some issues instead of the dumb stuff.

No, the Constitution allows Congress to certify the election results according to statute, and the statute gives them the right to see whether the states have properly certified the results with matching seals and signatures, etc.

Nowhere is Congress given the right or responsibility to interpret the Constitution. That job is specifically enumerated as belonging to the judiciary.

A competing candidate in N.H. has filed a federal court challenge. She’s a lawyer running and likely will get no votes, but .... she does have standing. That’s the one to watch.

Again, SCOTUS at this point would likely want more foreign born folks running and winning. So doubt NBC has any meaning any more.

They want to continue to delude the nutty birthers and ignorant, misinformed masses that this is something to worry about it, so they have in the back of the mind that they can’t take the chance.

The board acted in accordance with the acts of congress, as duly appointed by the constitution to deal with matters of citizenship.

Nothing there to be adjudicated.

Do not be deceived, Cruz is not nor will he ever be natural born. Look who appoints judges... By and large lawyers claim to fame is to sit in judgment and dissemble the Constitution. This bunch claimed there is a Constitutional right to kill the unborn.

Does anyone realize how many people living in foreign countries are now eligible to be potus under this ruling???

ANYONE born to a father OR mother of US citizenship is now a natural born citizen once they meet residency requirements.

Koreans, Vietnamese, Mexican, Chinese, RUSSIAN... The list goes on.... All they got to do is move here and stay for a while.

I wonder how many foreigners just became natural born citizens of the US overnight now?

Experts on all sides of the issue have acknowledged that there has been no ruling directly defining “natural born citizen”. No election board has the authority to interpret the US Constitution. Yes, Congress has made laws governing which people are US citizens at birth but Congress has never had the authority to define the terminology of the US Constitution. The judiciary is specifically required to decide cases when the meaning of the Constitution has to be interpreted and this is clearly one of those situations.

It’s not as broad as you think.

I believe you need to have at least one parent be a resident citizen of the United States within five years prior to the birth of the child.

An issue for SCOTUS.

If you understood your Constitution, you would know the President is elected by the States. A case will only go to SCOTUS if the States disagree.

It is interesting that Trump has decided to not attack Rubio.

I guess getting rid of Trump takes out the anti-establishment competition, but Rubio is ok as the establishment straw man to receive his ‘kill shot’ later.

I think Trump is miscalculating. He won’t be able to stop Rubio later on if the Super Duper pac money goes there.

Also, Trump is too cheap to spend money on the ground game and too proud to take donations.

Would much better if Trump and Cruz were co-operating.

There will never be any ruling.

Congress did its constitutional function and settled the matter 200 years ago.

SCOTUS does not take up settled matters, they have important cases to hear.

The SCOTUS wont touch this case with a 10 foot barge pole. Outside the frenzied minds of Trumpbots and Daily Kos crazies, this Cruz birther nonsense will go exactly nowhere.
