Ted Cruz Is A 'Natural Born Citizen,' Board (Illinois) Of Election Finds

On the same day he won the Republican Iowa caucus, Sen. Ted Cruz of Texas got a favorable decision from the Illinois Board of Elections, which ruled that he met the citizenship criteria to appear on the state's primary ballot.

Two objectors, Lawrence Joyce and William Graham, had challenged Cruz's presidential bid with the board, contending that his name should not appear on the March 15 ballot because his candidacy did not comply with Article II of the Constitution.

In response to the filings, Cruz's lawyers relied on Supreme Court precedent, legal history and articles from noted constitutional scholars to defend the view that he is in fact "natural born" within the meaning in the Constitution.

You missed something...NATURALIZATION AND CITIZENSHIPCongress' power over naturalization is an exclusive power; no State has the power to constitute a foreign subject a citizen of the United States.1131 But power to naturalize aliens may be, and was early, devolved by Congress upon state courts of record.1132 And States may confer the right of suffrage upon resident aliens who have declared their intention to become citizens and many did so until recently.1133

The 14th Amendment also states “and subject to the jurisdiction of”. If you aren’t born in the US you are subject to the jurisdiction of.

The State of Illinois is so corrupt, organized crime runs the state’s prison system, so that Prison wardens and their staff are disciplined and fired if and when they interfere with the illegal activities of certain prisoners organized crime leaders and the Governor are protecting. This is the state where the Secretary of State filed the auto license renewal checks under his bed as a million dollar plus slush fund. This is the state where the Madigan bunch run all manner of corrupt rackets out of the state capitol. This is the state that was used to legitimize Obama and put him into the White House despite his lack of proper citizenship. Of course this Illinois election group is going to reject any natural born citizenship challenges, because they would have to acknowledge the illegitimacy of Obama if they tried to do any differently.

No, Congress and the POTUS can not change Roe v WAde. That can only be done by a Constitutional amendment or SCOTUS overturning Roe v Wade.

The power of Congress over the judiciary is the power of denying confirmation of Presidential appointees such as judges and Justices.

The power of the executive over the judiciary is the ability/responsibility of appointing the judges/Justices.

If there is a case - that is, where there is an injured party who files suit- or a controversy involving the US Constitution, the judiciary has the responsibility to decide the case or controversy in regards to both finding of facts and to interpreting the meaning of the Constitution.

Quite a few presidents weren't natural born citizens.

Yes, the first Seven, Chester A Arthur and the current one.

The first seven were grandfathered in, Chester A Arthur lied about it, and the current one came along when the nation has descended into idiocy and could no longer remember basic foundational principles.

But the other 36 were natural citizens.

No, it was stated matter of factly. Read the Supreme Court statement. The laws are quite plain. No person born abroad and outside the jurisdiction of the United States can possibly be a natural born citizen, regardless of what any corrupt government officials have to say to the contrary about the matter. These corrupt officials have no power to change Nature and the physical nature of the birth which exists outside of and before the existence of manmade statutory law.

This only defines the states from the country in that a state may grant suffrage (and other privileges) but not citizenship.
For the purposes of our discussion, Texas can accept Ted Cruz as a resident and even allow him to vote but cannot bestow citizenship.

I’m just referring to the 20 or 30 who chant their candidate’s name and then laugh maniacally. Yes, most are more sober, even if I disagree with their conclusions. And some of my fellow Cruz supporters are a bit unhinged.

But power to naturalize aliens...

USC 8 is that power with laws duly enacted by Congress under Constitutional authority.

Aliens need naturalization and USC 8, a naturalization law, does so.

Actually, they can. Roe v. Wade is not part of the Constitution - if is just a court decision. Congress could pass a law banning abortion or just returning the issue to the states, and then include a clause that removes the jurisdiction of the courts to rule on the constitutionality of the statute.

"In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make."

So Congress clearly has the ability to deny the court jurisdiction over a statute. And when this power has been used previously, the Court agreed that Congress had the power to do so.

You’ll be laughing out of your aft orifice if they get their way in denying the Constitution, because they can use someone like Obama or Cruz or Rubio or etc. to promote legislation or Executive Orders that take away your present U.S. citizenship, whether natural born or naturalized, and come scoop you up for violating a Politically Correct statute and shove you into a concentration camp. Such a maneuver is exactly what Obama’s mentor, Bill Ayres, discussed and planned with a group scheming on how they were going to govern after they seized control of the U.S. Government. And here you are today laughing about how you think it is so funny that you can condone or even help Cruz and others nullify the Constitution.

Resident aliens have no bearing in this conversation. The phrase “subject to the jurisdiction of” does have bearing in the meaning of the 14th Amendment and its application of citizenship.
