I, too, believe it is a States Rights issue.

I really don't care which way each state rules. To be honest, the strength/weakness of my own marriage has never depended one bit on who anyone else is sleeping with or "married" to.

I think that even if the Court does overrule itself and return to the states, they'll have a hard time putting the cat back in the bag.

Congress has the power to overturn the Supreme Court decision.

Trump can sign a passed bill as President.

Congress also has the right to prevent the Supreme Court form ever adjudicating the issue again.

That is the way to right this wrong.

No—The Natural Duty of human beings to raise one’s own genetic offspring is embedded in the Lockean philosophy of our US Constitution and our “Justice” System.

With our INDIVIDUAL Natural Rights, come our Natural Duties, which includes Natural Rights of babies—ALL INDIVIDUAL HUMAN BEINGS-—to have their biological parents raise them. They can NEVER be bought and sold—sperm banks should be illegal because they are immoral and dehumanizing. They use humans as a “Means” which is unconstitutional.

To deny Natural Rights is impossible...they are unalienable as stated in our Founding Documents. To treat humans-—to buy and sell babies that unnatural “marriage’ would promote-—is irrational and dehumanization of children.

We have to obey Natural Laws which are God’s Laws. As St. Thomas Aquinas knew in his Summa-—Faith and Reason go hand in hand . Blind faith (no reason) is evil-—as evil as faith in Satan.

Our Natural Rights can’t be infringed by popular “votes” even if they get the majority of the State. NEVER. That is why Scalia is so dense and ignorant when he says that abortion is a “State’s Rights” issue——au contraire——it is a Natural Right to Life, which is ONLY from God and is inherent. Man CAN’T infringe on that Natural Right or Natural DUTIES.

Rule of Law embraces HIGHER LAW-—not irrational, arbitrary, man-made up laws and regulations which kill off the weak or old or buy and sell babies or baby parts. It is Satanism—forcing an irrational, vile religion which is antithetical to the Constitution and our Bill of Rights..

We are supposed to have Rule of Law-—not Rule of some insane satanist Man (like obama or Kagan or the evil Marxist Court, who DENY Natural Rights, DENY individualism, and private property and mandate slavery to the State and oligarchs.

All Marxists , Islamists and satanists should be banned from government like it was at the Founding. They are without Right Reason. They could be assigned as mentally ill/insane.

People with NO belief in God-Given Natural Rights can NOT RULE ON ANYTHING-—because they are too dumb to even understand a puerile simple philoosphy-—much less Lockean or Natural Law Theory.

Doggone Donald. Do not listen to the state’s rights people. If the states get it we start all over. Nominate justices who realize that SSM is an assault on the Natural Law on which the Constitution is based and therefore unconstitutional period.

Radical in today’s culture? Yes. But perennial wisdom it is and it will prevail or we destroy ourselves.

I believe Donald was talking about Kim and her job performance, not about Donald’s view of gay marriage.

Best to remember he talks form a business owner mindset a lot of the time.

And his comment was correct, it was (sort of) decided on by SC so for the time being, its the guideline we are to follow legally.

Why couldn't it go back to the states, with the "marriage" licenses already in place grandfathered in.

Trump seems to have a good sense of states rights vs Constitutional obligations of the federal government. Makes me wonder if he isn't being tutored by someone real wise on that issue.

I don't see the SC overturning it.

You do not have the have the Supreme Court overruling it. All Congress needs to do is withdraw the jurisdiction of the Supreme Court and of the lower courts to review state laws concerning marriage. All that is needed is the majority vote of Congress and the signature of the president. BTW, the same action can be used to withdraw the courts' jurisdiction over state laws concerning abortion.

As far back as 2000, Trump was advocating the idea of amending the 1964 Civil Rights Act to prohibit discrimination based on sexual orientation – something the currently-pending Equality Act would basically do if lawmakers on Capitol Hill ever decided to pass it.
“[A]mending the Civil Rights Act would grant the same protection to gay people that we give to other Americans – it’s only fair,” Trump told The Advocate in February, 2000. In the same interview, Trump said he favored “a very strong domestic-partnership law” that guaranteed same-sex couples equal legal rights as married, heterosexual couples. Trump also said he believed Don’t Ask, Don’t Tell – the military’s then-ban on openly gay service members – had “clearly failed.”

I disagree. It says powers not federal go to the states or to the people. This decision belongs to the people, and across the nation the people rejected it.

True. And yet they won't watch even one Trump speech, dozens of which are all archived on You Tube, and each new speech can be streamed live. You Tube search "Trump Live", then filter by upload date. There are usually multiple live streams.

They remind me of media and other haters who were experts on Rush Limbaugh all these years, and knew exactly what he said and what his show was like---yet they'd never listened to one minute of his show in 25 years. Yet they could rant endlessly about him. That's the way the Cruzers are with Trump. They know they hate him, but never have listened to a word he says.

The decision by the USSC is outside their jurisdiction as it IS a States Rights Issue. Where in the Constitution does marriage fall under Federal powers? It doesn’t.

AMENDMENT X
“ The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Essentially, the Supreme Court went against the WILL of the PEOPLE! Those states which had enacted marriage laws ha every right to do so. The Supreme court overruled the will of the people.
