If Hillary is Elected President and Indicted, Can She Pardon Herself?

Former House Majority Leader Tom DeLay stirred rumors last Monday when he told Newsmax his friends at the FBI are ready to indict presidential candidate Hillary Clinton for mishandling classified information over a private insecure server while Secretary of State.

Whether the FBI is going to indict her—or if Delay even has friends—isn't known for sure. What we do know is that the State Department is withholding seven email chains from public release due to "top secret" content.

A lack of Congressional spine

That's a given.

"If Hillary is Elected President and Indicted, Can She Pardon Herself?"

If Hillary is elected President, why wouldn't she just not indict herself in the first place?

By accepting any pardon whether by Obama or Hillary herself Hillary would be announcing to the world was guilty of the crimes charged. Hillary’s exaggerated narcissism would be tested beyond her limits.

Yes, Nixon was pardoned without an indictment.

"The possibility of a President pardoning himself for a crime is not precluded by the explicit language of the Constitution, and, during the summer of 1974, some of President Richard M. Nixon's lawyers argued that it was constitutionally permissible. But a broader reading of the Constitution and the general principles of the traditions of United States law might lead to the conclusion that a self-pardon is constitutionally impermissible. It would seem to violate the principles that a man should not be a judge in his own case; that the rule of law is supreme and the United States is a nation of laws, not men; and that the President is not above the law. "

KY people do see “courage” there, or whatever they see, they aren’t saying. I think what they really see is “largesse” even if the Kentuckians don’t know the meaning of the word.

Expect a new theme of her campaign to be “Elect Hillary! so she can pardon herself!”.

Wow!! You have yourself one hell of a tagline there. I’m undoubtedly going to use it when debating LIBS.

Legally and Constitutionally, I do not think she can.
But when has that ever stopped the Clinton?

That’s the real answer.
A POTUS pardoning herself would lose the consent of the governed.

Came from “Let’s Get The Show On The Road” by the Michael Stanley Band.

Considered changing it a few times, but never came up with anything I liked better.

Question doesn’t apply.

A grand jury cannot indict a sitting president.

But she could pardon herself from indictment after she left office.

Here’s my take.

She and Obama conspired with terrorists to have Amb Stevens kidnapped in Benghazi. The reason was so that two weeks before the election Obama and Hillary could get the release of Amb Stevens thereby being heroes and winning the election by landslide numbers.

After ther terrorists lost a lot of lives they felt betrayed and paraded Stevens body through the streets.

Wha? Did people ever hear about her husband getting impeached?

It’s Hillary. My God in heaven please help us

It’s the Clintons. They are above the law. That’s it. Deal with it

That is incorrect. The President can only pardon those individuals convicted in a Federal Court. He has no Constitutional authority to pardon anyone that was convicted by state court.

This was discussed quite a bit during the Nixon crisis.

I think the most accurate answer is that the President can order his employees (AG on down) not to investigate his person, not to convene a Grand Jury, not to indict himself, and not to prosecute. If he could not do these things, he would not be the chief officer of the executive branch. Whether the DC municipal police or the police agencies of a State could detain or arrest a President for a state or municipal offense is less clear , the answer is, they probably could. I believe Ulysses S. Grant got a speeding ticket while President.

After Congress removes a President, and presuming no pardon by his successor, he can be investigated, indicted, tried, convicted, and punished in the normal way.

Whether a President can pardon himself for any offenses not yet revealed is not clear.
