Leading members of Congress are ripping IRS officials for erasing a computer hard drive after a federal judge ordered it to be preserved.
âThe destruction of evidence subject to preservation orders and subpoenas has been an ongoing problem under your leadership at the IRS,â Committee on House Oversight and Government Reform Chairman Jason Chaffetz and Rep. Jim Jordan , wrote in a letter to IRS Commissioner John Koskinen late Thursday.
âIt is stunning to see that the IRS does not take reasonable care to preserve documents that it is legally required to protect,â Chaffetz, a Utah Republican, and Jordan, an Ohio Republican, said in the letter to Koskinen.
The IRS recently admitted in court to erasing the hard drive even though a federal judge had issued a preservation related to a Microsoft Freedom of Information Act lawsuit against the federal tax agency last year, according to court documents. Microsoft accuses the IRS of inappropriately hiring an outside law firm to audit it and of failing to hand over related documents requested under the FOIA.
Chaffetz and other members of the oversight panel began calling for Koskinenâs impeachment in October. Chaffetz and Jordan in their letter point out that the IRS in March 2014 also destroyed 422 backup tapes containing as many as 24,000 emails sent or received by Lois Lerner, former director of IRSâ Exempt Organizations Division.

If a private business did the same thing to the IRS things would be handled very differently.
If the government refuses to hold its own accountable then they’re just lawless and undeserving of their authority to be recognized.
There are not enough jail cells to hold all the law breakng scum from this administration.
My sources tell me it was an exceedingly stern letter, and John Koskinen's initial reaction was:
Wow.
A strongly folded letter.
Thing will change now! /s
Is a letter more strong than a red line?
Sound and fury and the corruption marches on. Nothing will change until Trump is sworn in and hopefully he and Cruz kiss and make up and Cruz gets the AG position. Then they can clean out the chicken coop.

Here, they don't even serve time in jail - ever.
“Samuel Maruca, owner of the hard drive in question and a former senior IRS executive, participated in the IRS hiring of the outside law firm Quinn Emanuel Urquhart & Sullivan LLP allegedly to investigate Microsoft. Maruca left the IRS in August 2014, according to court documents.”

Former IRS Official Sam Maruca Rejoins Covingtonâs Tax Practice
8/5/2014
WASHINGTON, DC, August 4, 2014 â Covington & Burling is pleased to announce that Sam Maruca, most recently the Director of Transfer Pricing Operations for the Large Business and International Division at the U.S. Internal Revenue Service, has returned to the firm as a partner. Mr. Maruca will be resident in the firmâs Washington D.C. office, and will advise clients on all facets of federal income tax controversy and risk assessment, including transfer pricing matters.
âWe are delighted to welcome Sam back to the firm,â said Timothy Hester, chair of the firmâs management committee. âSam has been at the heart of U.S. transfer pricing policy and enforcement over the last three years. He adds another dimension to our regulatory and risk management strategy, and a timely one given the growing importance of transfer pricing to multinational corporations and governments.â
Mr. Maruca has practiced in the field of federal income tax for more than 30 years. He has represented clients in numerous business sectors, including information technology, pharmaceutical, biotechnology, communications, specialty materials and retail.
âSam is a top-flight international tax lawyer, whose exceptional experience in transfer pricing and transfer pricing controversies will again enhance our existing practice,â said Dan Luchsinger and Reeves Westbrook, co-chairs of the firmâs tax practice.
During his tenure at the IRS, Mr. Maruca instituted changes that resulted in a more sophisticated and comprehensive approach to transfer pricing audits and resolutions; new internal processes to leverage the IRS knowledge base; and improvements in the dialogue and relationships between the U.S. and its key trading partners throughout the world.
âI am delighted to return to Covington,â said Mr. Maruca, who spent three years in the firmâs tax group before being selected by the IRS to run its newly-formed transfer pricing unit. âGiven the firmâs justified reputation as one of the top litigation and dispute resolution firms in the country, and the deep substantive strength of its existing tax practice, I cannot imagine a better place to grow a premier controversy practice. I believe I can help the firm position itself as a global trouble-shooter and risk manager for multinational enterprises, wherever they may be headquartered or doing business.â
Mr. Maruca earned his bachelorâs degree from Yale University and his law degree from Georgetown University.
The usual remedy for that sort of behavior would be a bench warrant for contempt of court. Let the Federal Marshalls slap some bracelets on a few high-ranking IRS officials and I suspect attitudes would quickly “adjust”.
So why aren’t they working with the House of Representatives to start impeachment proceedings against IRS Commissioner Koskinen immediately?
The answer is lifetime sentences and removal of all benefits.
Agreed—this is truly outrageous abuse of power or bureaucracy—whatever the hell protects these people. This cannot stand without consequences any of the rest of us would face.
All they do is pontificate and nothing happens. All of them should be in jail.
This is the kind of crap Americans are tired of.
This SHOULD be big news, but outrageous corruption has become commonplace.
Koskinken, the grinning little d-bag. He looks like a clerk at Auschwitz!
they’re moving their lips, flapping their gums, warming the air, but not a damn thing is being done - no wonder this stuff happens.
Wanna get our attention? Want us to take you seriously?
Have the Speaker of the House issue an arrest warrant for Koskinen for obstruction of justice, send the Sergeant at Arms out with some US Marshals to arrest Koskinen and throw his goat-smelling ass in the slam!
Why would they? There are apparently no consequences for destroying evidence, as long as you work for the government.
So what are you going to do about it? Nothing? That’s what I thought.
