Rubio fights off 'birther' lawsuit in Florida

Senator under fire for 'natural-born citizen' standard.

Sen. Ted Cruz isn't the only Republican candidate fighting off accusations about his birth status and whether he qualifies for the presidency - Sen. Marco Rubio is actually facing a lawsuit on the same.

Michael Voeltz, a Fort Lauderdale resident, filed a suit against Rubio, alleging the Florida senator - who's coming in third in national polls, behind Cruz and first-place Donald Trump - fails to comply with the Supreme Court definition of "natural-born citizen," Breitbart reported.

Rubio's campaign responded with a request for the court to dismiss the "birther" claims.

"Rubio filed a motion to dismiss ... [The complaint] show that Rubio's legal team spent considerable time researching the issue. 'Senator Rubio is a natural born citizen of the United States and he is eligible to be president of the United States,' it concludes. ... [The complaint] confirmed his parents were given citizenship in 1975. Rubio at the time said he did not know why his parents waited," reported the Tampa Bay Times.

The filing also indicated Rubio's parents came to the United States in 1956. Rubio was born on May 28, 1971, a few years before his parents were given citizenship.

Cruz has been fighting off charges he's not a citizen of the United States because he was born in Alberta, Canada, to a mother who was an American citizen. Cruz actually held dual citizenship as a Canadian and American until June 2014, when he renounced his Canadian ties.

I understand your point, but I was commenting that it would have been nice if our candidates had been willing to bring it up with the same zeal about Obama as they now do against each other.

IF the Courts took up the case on the merits alone, that puts the last 7yrs in jeopardy.

NO WAY will the Courts upturn the apple card for some dusty, old document! There’s PRECEDENT to keep

Ah Ha! Senator Ted has stated our Constitution could do with more amendments. An amendment to define exactly what an NBC might be and how it might be obtained is certainly needed. Congress cannot amend our Constitution on its own even though they might have tried. Unbelievable our forward thinking founding fathers did not make this statement more explicit whereby we would know their exact intent. And when it comes to electing a President one would think that ALL AMERICANS would have standing in order to get the facts right.

Well if Ted or Rubio get elected Prez, they can just make an executive order declaring they are natural born citizens just like our resident in the WH does whatever he pleases.

Very troubling to conclude that naturalized citizens and children born in the US to legal immigrants waiting for naturalization do not have equal rights: i.e. the right to be selected by voters as POTUS.

The Founders’ intent (to prohibit pro-British pro-monarchists from the office) have long since become moot.

Time to tidy up the parameters for POTUS eligibility. Otherwise we have millions of second class citizens.

The lack of standing claim is legally very solid, like it or not. Multiple lawsuits were filed against Obola challenging his eligibility, and the vast majority was dismissed on just that basis. As it stands now, about the only persons or entities that might possibly be able to establish standing are one of the target’s opponents for the nomination, one of his DemonCrap opponents for the election,and/or the DNC. Even then,please note I said “might possibly,” not “would.”

I understand that. But that’s not the issue.

The issue is that the DEMS will make use of anything , no matter whether it’s legal, or right, to win.

Look at that they did to Scooter Libby. There are dozens of other examples where people have been successfully prosecuted when they did nothing wrong.

People like Valerie Jarrett will not leave their position of power and wealth without a fight to the death.
