With John McCain now stepping in and agreeing with Donald Trump that Sen. Ted Cruz (R-Texas) may be in trouble in his Presidential run because he was born in Canada, Texas constitutional law scholar Gerald Treece says it is time to end the silliness and move on, saying there is no doubt that Cruz, who was born in Canada and with a mother who is American and a father who is Cuban is in fact qualified to be President, News Radio 1200 WOAI reports.
Trump is warning of a constitutional challenge by Democrats if Cruz is the Republican nominee. But Treece, who is a professor of constitutional law at the South Texas College of Law, says that challenge wouldn't get very far.
"While there are very few decisions on this," said Treece, pointing out that the U.S. Supreme court has never specifically ruled on what the framers meant when they said the President has to be a 'Natural Born Citizen,' but he says there is plenty of scholarship on the issue.
"There is so much scholarship and it is almost unanimous, that not only is Cruz qualified to be President as a Natural Born Citizen, so is President Obama."
And McCain, who was born in the Panama Canal Zone, and Mitt Romney, whose father was born in Mexico.
Treece says all of this comes from the concerns that people around the world had in the 18th Century about being governed by 'foreigners.'
"What they didn't want in a President was a foreigner, someone coming over here from the dreaded England or the dreaded France and becoming President."

Because Federal Courts do not give advisory opinions. There are a few circumstances in which a Federal Court can give a lower court guidance if that court requests that guidance.
I’m not sure the Courts want to get into this.
Shouldn’t be an issue, if for no other reason that all of the entities who had any responsibility for investigating and holding a presidential candidate to the Constitutional standard have effectively waived the NBC qualification by their inaction with regard to Obama, making the matter moot hereafter. The Democrats didn’t care, and the Republicans were too cowardly to pursue it, so neither group has any credibility in raising it with regard to Cruz.
Because under the law AS WRITTEN when he was born his mother was not able to pass on citizenship. Only if he was born in the US would he become a natural born citizen. That Hawaiian birth certificate is absolutely crucial to his meeting requirements to be President.
That, and the previous McCain hero issue, from Trump.

I think its better for Cruz to deal with this now instead of later. You know the democrats will use whatever they can to beat him. It’s better to clear this up once and for all.
But I don't see this as helping Cruz. It may not hurt him. But he spent more than a week in the weeds (yes, in policy weeds) with Rubio over who did what on the Gang of Eight bill.
Again, I'm a Trump guy, but Cruz by getting into this stuff continually looks like someone playing small ball while Trump has the "big picture" issues. If I was Cruz's manager I'd be doing the biggest-vision things I could and refuse to comment on Rubio or the birth issue.

The purpose of Article II, Section I clause 5 was to prevent undue foreign influence on the office of the presidency, PARTICULARLY thru a father owing allegiance to a foreign sovereignty. The framers took their definition for NBC from Emmerich De Vattel’s Law of Nations, the 212th paragraph of which was quoted in it’s entirety in the 1814 Venus Merchantman decision. The Law of Nations is referred to in Article I of the constitution. That definition referred to an NBC as being born of two citizen parents and born on the soil of the nation. That definition was cited in the 1868 case of Minor vs Hapersett, and Wong Kim Ark vs US. De Vattel has been cited and accepted in dozens of SCOTUS and federal lower court rulings. The framers were patriarchs who believed that the citizenship of the children followed the citizenship of the father.
Anyone else hear that Cruz has sealed all his birth documents? A theory was put up as to why Cruz did this in that some are saying they cannot find a birth certificate in Delaware for his American mother. Could these statements possibly be true, or is it just rumor mongering??? I like Cruz and hope he goes to Court and gets this cleared up NOW before crunch time.

It seems to be a question of if the records are sealed by default or by order of the person they pertain to. I haven’t seen a clear answer on that. There is no doubt though that in either case Ted could unseal them.
If Obama was not born in the United States, he's not even a citizen. Obama's only claim to citizenship is the 14th amendment.
Under the statute that gives women the right to confer citizen to their children which are born in a foreign country, Stanley Ann Dunham does not meet the necessary requirements. She didn't meet the requirements of the law.
So if Obama was born in a foreign country, he is not a US citizen at all. He has no claim on US Citizenship. He is an Alien.
This is why it is utterly essential to him that he demonstrate that he was born in the United States, or a territory. If he wasn't actually born in Hawaii, he's an alien, not a citizen.

Everyone who agrees with the premis of man caused global warming, for example, is called a "scientist" while those opposed, despite scientific credentials, are called "deniers".
They do the same with any opinion given that agrees with their agenda. He is an "expert". Those opposed are marginalized with some qualifier that has negative connotation.
