A patient undergoing a colonoscopy pressed ârecordâ on his smartphone before being sedated, hoping to capture instructions from his physicians after the procedure. What he heard instead was shocking: âIn addition to their vicious commentary, the doctors discussed avoiding the man after the colonoscopy, instructing an assistant to lie to him, and then placed a false diagnosis on his chart.â
The incident cost his anesthesiologist $500,000 in the ensuing malpractice and defamation trial.
The recording has to be heard to be believed.

I’m 83 and my mother lived a long life but my father died at 32.
We do what we can do,make the most of each day, and then turn it over to God.
.
Clearly defamation, when she said he probably has syphilis. Slam dunk! Ka-ching!
Thank you.It was tough, because we had just lost our parents, mother died on Mothers Day, followed by our father,on my birthday. My brother and I were business partners in our family business , and I didn’t expect him to come into my office and shut the door to tell me he had cancer,5 mos after the second parent passed.
It was an “I flew out the door” shot.
you are sharp. That makes excellent sense.
I know I will be laid on my right side, and there is no reason for them to poke around on the left.
loose gown would hide it.
I don’t drink but I can imagine.
I will bet this is in a doc-in-the-box kind of place, a specialty practice in a non-hospital setting somewhere.
The people I know who do this type of thing and the procedures I have seen done are very professional and have never even come remotely close to this grossly unprofessional behavior. I would think the familiarity and casual approach in a non-hospital setting could get out of hand in the lack of strong leadership, guidelines and policies.
Also, the fact they took the stuff into the procedure room (under the stretcher to keep it with the patient?) is to me, a dead giveaway. I have never seen a hospital do that, even for procedures like a minor knee surgery type of thing.
No comparison. Mild walk in the park compared to your deal.
My Sister is the same as me, now she had to have a benign tumor removed from one of her ovaries then they went on and did a Hysterectomy and would no take anything but aspirin. Now that is tough.
Actually the colonoscopy really is more uncomfortable than anything else but they push the sedation on everyone and most take it.
Could have had a pocket in the gown.
My first colonoscopy I wasn’t having any issues and they didn’t find any polyps. 6 years later I became constipated and went to a gastroenterologist.
He found a large polyp. Since I already had a breast lumpectomy, I was glad I went through it again altho I knew I would have a hard time getting the ‘crap’ to stay down. I got to the last drink of and puked. but it was worth getting rid of the polyp. Not worth delaying! Just do it!
I remember one time, a gown had a pocket.
this has happened before. what is it with discourse during colonoscopies lol?
my doctor is great. caught pre cancerous cyst almost almost three centimeters long and removed it. same with some early barretts cells on the other side :)
I don’t care what he calls me during the procedure, as long as he keeps treating me and is one of the best.
LOL
Whoa, that’s very bad. It’s such a truly invasive and personal procedure, the last thing you need is something like that to happen. The wife and I had ours in the last year, and they went off without a hitch.
Prayers for those folks!
My brother in law developed colon cancer. He is one year young than me. That inspired me to get a colonoscopy.
Nothing to it.
Like going to the dentist.
Really. Everyone said fasting and drinking the laxative is the worst. But, it wasn’t really that difficult. You get to drink broth and pop.
If you are the age and have cancer in your family, go ahead and get it out of the way.
All my clothes and personal items were bagged and placed under my rolling bed/operating table. They were underneath me during the entire procedure. I could have had my phone on and they never would have known.
I have been told that elderly patients should not have screening colonoscopies. There are reasons why, but the bottom line is, as you get older, there are a host of things that can make a colonoscopy more difficult to perform, and can increase the likelihood that there will be a complication, perforation being one of them.
Screening colonoscopies for people in generally good health between 50 and 60 are safe, and well worth the risk. If you have a blood relative with colon cancer, is is foolhardy not to have a colonoscopy, even with risks.
For people who may be more prone to problems, a CT colonoscopy can be performed, and there are some new genetically based stool analysis procedures that are pretty good.
People who are elderly (like the ones you described) should have a very good reason to have a colonoscopy.
My feeling is one complication can and does happen to any physician in a wide range of procedures. Even the best surgeons have things that go wrong, because fixing people isn’t like fixing brakes on a car. But if a physician displays a pattern, people would be wise to pay attention and take their business elsewhere.
I’m fairly sure of where he did not smuggle it......
Remembering the Monica Lewinsky/Linda Tripp recorded conversations in Virginia, I wonder how these recorded conversations were ever allowed as evidence in a Virginia court.
Virginia is a one party consent jurisdiction and Virginia Code § 19.2-62 makes it a crime to intercept wire, electronic or oral communications, except if one party of the conversation consents to it. Again, this means that if you are participating in the conversation then you may record the conversation without the consent of the other parties, but if you are not participating in the conversation (the other parties do not know you are listening), then you need at least one party to the conservation to consent to the recording.
"I am not interested in seeing video. I am not interested in discussion. I don't have any interest in the course of my procedure. I don't want to wake up in the middle of it and have to go down again, even if I won't remember it. When I go in, I don't want to remember anything, and I don't care if you have to give me extra to make that happen. I am sure you will do a great job, and I look forward to speaking with you after the procedure."
Last thing I remembered was moving onto the table from my stretcher as they bustled around me while I rolled onto my side, and the physician asking me: "Are you comfortable? Good. Let's get started..."
And that was it.
I had a colonoscopy 6 weeks ago, in a small rural hospital. They put my clothes and iPad under the gurney.
They also used a general anesthetic on me. I did not like the poor recovery I had. At the follow-up with the surgeon, I told him what I wanted for the next procedure. I have a history of colon cancer and have had a few polyps since, so there will be another colonoscopy in 3 years.
