If they are in the U.S. illegally, they need to first go home. Then, they should be able to apply for re-entry IF they have not broken our laws.

Correct, anyone that has illegally entered this country should have to leave and apply to re-enter. However, by illegally coming here in the first place, they have already violated our laws, and can't re-enter. While I don't disagree with that, I doubt it would be implemented in that sense.
