This is a Texas situation and the Jury will have doubts....so I don’t think it’s a case that you really have great chances. My guess is that the school will look at the cost of defense and make a one-time offer of $100k for the kid to settle up and never bring up this topic again. The kid’s family may be thinking they can get one million out of this but it’ll never happen. Once you ask the magic question of some ‘expert’ of what you can do with a briefcase with a clock inside....the game is over. Now, if this kid had made a spy-brief-case with forty options and the clock was just one of the options....he might have a good case.
