Traffic Stop Quickly Escalated When Driver Informed Officer of Concealed Carry Permit

Gonzalez claims he was unfairly targeted because he was carrying a gun.

The traffic stop began routine enough. Rosenberg officer Sgt. Anthony Schnacky asked Gonzalez for his license and insurance.

"Yeah, what's the reason you stopped me?" Gonzalez asked.

"I'll tell you in just a minute," the officer replied.

But when Gonzalez informed Sgt. Schnacky that he was legally carrying a concealed firearm, the tone of the situation shifted dramatically.

The officer called for backup and they both approached the driver's window -- one of them with his gun drawn. Schnacky ordered Gonzalez to put his hands on the steering wheel and "step out of the truck" with his hands on the back of his head.

Gonzalez was then handcuffed and arrested. When he asked the officer why he was being arrested, Schnacky replied, "For your traffic violations."

"Just because I have a handgun on me and a license to carry should not be a big deal, but that is what made it the turning point," Gonzalez told KPRC-TV, adding that he would have likely received a citation and set free if he wasn't armed at the time.

The dash cam footage aired by KPRC-TV is heavily edited and doesn't include the entire interaction that occurred prior to the man's arrest. Schnacky also told the backup officer that Gonzalez was being uncooperative, according to the news station.

The Rosenberg Police Department has reportedly determined the officers didn't violate any police procedures.

So I was on the side of the guy being pulled over until they said he was being arrested for traffic violations. That leads me to believe he had a warrant for his arrest.
With that context (which I am assuming) this entire incident makes a lot more sense. If you’re being arrested for outstanding warrants and announce to a cop that you are carrying a weapon legally I would fully expect them to not announce that they’re arresting you but have you safely get out of the car and then place you into custody.
The article wants to infer that he was just carrying concealed and was arrested because of it. I don’t buy that for a second.

He screwed up..when he told them he had a CCL.

Some states require you to tell them that you're packin'; don't know about Texas though.

Notice the plural here. He might have had numerous violations on his record that he hadn't bothered to attend to. As others have noted, there's perhaps a bit more to it than meets the eye.

When one of “them” dies they line the streets and bridges as a parade, but when one of them kills one of us there isn’t a peep.

Thankfully in FL we’re not required to out ourselves as carrying if stopped by the police.

Is it the law in TX that you must reveal you’re carrying if stopped, or did the guy just offer the info?

I think he told the officers, and that is what the law in Texas requires when pulled over.

Got pulled over in PA for a broken light. Told the officer I was carrying....I was told “Be surprised if you were’t. Where is it?” I said ‘Ankle holster’. He looked my papers over, grinned and said have a good day.

Heck both police officers could have emptied their pistols into the driver's back and the police department would still have ruled the officers didn't violate any police procedures.

Texas requires you present both your driver’s license and CHL license any time you are asked for your identification.

You are also required to tell the officer whether or not you are currently carrying.

In Tennessee it’s polite to inform them but as soon as they run your license, they are going to know anyways.

IMO- it’s best to tell them upfront. Especially since my infraction was only a blown headlight.
I just handed the officer my permit with my license. He didn’t seem to care one way or another.

according to my legal class taught by a detective they know if you have a colorado chp. they run the plates, get the car registration name, then run a second database, unconnected to dmv, to determine if you have a permit. it is best to wait patiently with both hands on the steering wheel, no sudden moves and never use the word GUN.
