President Obama is on a collision course with congressional Republicans over the Guantánamo Bay detention facility, with increasing chatter in Washington that he might seek to close the prison through executive action.
The administration is expected to hand over a plan to Congress for shuttering the Cuban prison, in an attempt to fulfill a long-standing campaign pledge before Obama leaves office.
But even as Obama seeks cooperation from Congress, White House press secretary Josh Earnest has refused to rule out unilateral action to close the prison camp. Earnest on Friday said Obama "certainly wouldn't take off the table the ability of the president to use whatever authority is available to him."
There are 112 detainees left at the prison, including dozens that are considered "too dangerous to release" that would need to be transferred to the U.S. mainland.
Congressional Republicans are sending strong signals that any plan to close Guantánamo Bay is dead on arrival.
Sen. Cory Gardner (R-Colo.) suggested that the president is breaking the law by even having Defense Department officials study possible U.S. alternatives to the Cuban prison.
"Look, the law is very clear. The law states no money shall be made available, shall be used, can be designated for the assistance of the transfer of Guantanamo Bay detainees," he said.
Gardner added that he sent Obama a letter asking, "what basis in law does he believe he has to violate the law," and hadn't received a response.
Sen. Pat Roberts (R-Kansas) has called Obama "damn stubborn" about closing the prison camp.
"It just raises all this dust in opposition," he added. "It's a bad idea, really a bad idea. I hope those of us in the Congress will maintain our vigilance."

I don’t use the /s tag at all. I like to see who take it as serious and straight. Those people have not the wit to understand what is actually happening out there and are not worth engaging in argument. They understand yes and no but not what if and why.
I’m assuming any transfer would involve use of and payment to military and/or military personnel, and private funding for that is probably not permitted. The money somehow would have to go thru DOD or some other govt entity, and I don’t believe we can earmark our tax ‘contributions.’
Really, all Obama has to do is do it; it’s been his pattern all along, bypass Congress, just issue edicts and, voila!, it’s done!
Who will stop him? And how?
It needs to stay open because that is where obozo the assclown needs to be incarcerated when he gets dragged out of the white hut in a year.
congressional weenies will line up to kiss this magic negros ass as usual.
Congress has said NO to this punk and he will shove it up their asses and they will sit and do squat.
He’s starting by putting them in Colorado. Whatever havoc it causes will be buried by the media.
You may be right. I once contacted the DOJ to see if I could raise the money to put a group’s name on a smart bomb for Iraq. LOL
Can Paul stop him?
There's a special place at the White House for Gardner's letter. It's the same place all correspondence from Congressional Republicans goes:
Drop them off in front of the whitehut, with duplicate clockboy clocks. And obamaphones.
Communist Obama is going to give Gitmo to the CASTRO BROTHERS!! And SPINELESS Republicans will do NOTHING to stop him!
There was talk some time ago that a prison in Dixon IL was scheduled to received these guys. The rumor mill went silent but now hiring is taking place for Guards there. . Could this be the transfer point?
Barry will do whatever he pleases.
Congress will do nothing, perhaps not even squawk.
The bully threatens to subvert the will of the people once again.
This prison should never have been built because we shouldn’t have been taking prisoners. But now that it’s there what are we supposed to do with it? Keep these people locked up until they die a natural death? Apparently we don’t have enough on them to try them and execute them. If we do then we need to do it. Then we can close the prison.
We'll be lucky if he doesn't give the jihadis each 50 lb. of Semtex on their way out the door.
A frequent debate on FR has been whether The Impostor is more Communist or jihadist. I've always said the former, but the thing about synergy is that helping the one thing, helps the other.
He wants to agitate blacks. Realizing it was only his color that brought historic numbers of blacks to his elections, neither Sanders nor Clinton excites black voters. If he can goad republicans into impeaching him, his operatives will agitate each minority group into a fury to get them to the polls. Obama’s actions have always been about separating the races into squabbling interest groups, each with its own concerns, united only in their enmity for obama’s detractors.
Obama has their FBI files, and K Street has their receipts. They're totally compromised by interests not our own.
Is that a serious question?
