the original article no more establishes that (as DL implied) heroin use is not a victimless crime than the incident I cite establishes that alcohol use is not a victimless crime.

That would be true if the only criminal statutes on the books were against acts that have unwilling victims; sad to say, that is not the case. Leaving heroin where a child can get at it is an act that has a victim - but the heroin laws are much broader than that.
