Lawyers with the Justice Department on Thursday told a federal court that Hillary Clinton had the legal right to use her own email account and broke no laws in how she handled those messages, The Washington Times is reporting.
The lawyers defended the former secretary of state in a legal filing, saying they have no right to order Clinton to turn over any more emails or documents than those she has already given back to the government.
"There is no question that Secretary Clinton had authority to delete personal emails without agency supervision she appropriately could have done so even if she were working on a government server," the DOJ lawyers said, according to the Times. "Under policies issued by both the National Archives and Records Administration (NARA) and the State Department, individual officers and employees are permitted and expected to exercise judgment to determine what constitutes a federal record."
Clinton used her private email account and home server in lieu of the official government email system while she served as top diplomat from 2009 to 2013.
Judicial Watch, which has filed several law suits and records requests regarding Clinton's emails said the administration is ignoring its own rules.
Indeed, the State Departments own rules specify that personal records of a departing presidential appointee may not be removed from the government until the State Department records officer in cooperation with the S/ES or appropriate administrative office approves of the removal, a process which generally requires a hands-on examination of the materials, Judicial Watch said to the Times.

“Trust me” - Hillary.
The Most Corrupt and Criminal administration in American History makes way for the relic from the previous winner of that title.
Surprise, Surprise! Obama’s DOJ backs up Obama’s SOS
yes, but she does not have a ‘right’ to classified mail on her private server
*!BZZZZZZZT@!&^*!!!!
wrong
DOSJ = Department of SELECTIVE Justice
The Queen can do whatever she wants to do.
How is it legal and OK for anyone to use private Email with Top Secret information being exposed to hackers, foreign governments and various college students?
This is now precedent that this is OK, and Petrayus should be let off now as well if that was OK.
The stuff of Banana Republics.
Nothing happens on the Left in a vacuum.
There was a quid pro quo behind the scenes, no doubt of it.
Cui bono?
Forget private email. That’s a red herring.
Server....she had a private SERVER in her home.
I have a question that has never been asked or answered.
Did Hillary use her Government e-mail account? Did it have any classified or personal e-mails on it? How many e-mails were on that account.
What’s the point, you ask? I am betting she did most or all of her business on her personal account. Did our SOS only send and receive a few or handful of classified information via e-mail? I doubt it. I would think more than half her correspondence would be considered sensitive to classified.
This is pure crap.
Anybody else that would have tried that would be fired or in jail or both.
One of the worst construct of our system of government is to have the Department of Justice under the Executive branch. That’s like having the criminals be the ones that bring the charges against themselves.
What a racket!
Grasping at straws and relying on the ignorance (or complicity) of the Courts.
That first line from the article reads right of the Onion.
Can you imagine the firestorm if this was the Justice Department for Bush saying this?
Hillary to Obama: “the DOJ and FBI give me cover, or your travel records, college records and those photos of you in that place in downtown Chicago get released....”
can you say “rigged game?”
It’s the spin cycle again.
