Kentucky clerk appeals order putting her in jail

A Kentucky county clerk has appealed a judge's decision to put her in jail for refusing to issue marriage licenses to same-sex couples.

Attorneys for Rowan County Clerk Kim Davis officially appealed the ruling on Sunday. The three page motion does not include arguments as to why Davis should be released but amends Davis' earlier appeal of the judge's order.

Mat Staver, one of Davis' attorneys, said the marriage licenses issued Friday are "not worth the paper they are written on" because Davis refused to authorize them. But Rowan County Attorney Cecil Watkins says the licenses are valid. Bunning said he did not know if the licenses were valid but ordered them issued anyway.

Staver called the contempt hearing "a charade" saying that Bunning had his mind made up before the hearing began.

Governor Bunning should call the legislature into session to pass a new marriage law if he doesn’t know.

If the legislature can’t agree on and pass a new law, then what?

it seems to me that some people from outside the area are going to Rowan County with the intent of being turned away - theater.

There is little question that Davis has been targeted.

I just heard Bill Cunningham dropping a load about Davis needing to resign because she has to issue those licenses or if her religion won’t allow it she must resign.

Christians get to be cleaned out of elected public offices and the civil service just like Jews were in Germany back in the early 1930’s under the guise of ‘marriage equality’.

Plus they drove an hour. The county is not that big. Where are Gentry and Stamper from?

Yeah I had heard that but haven’t been able to confirm it.

No time was wasted attacking Davis’ personal life (divorce, etc), but no time was spent looking at these people from outside the area.

The judge definitely had his mind made up, since he had already supported “gay marriage” earlier,

However, there should have been a better plan in place for the opposition, because everybody knew that this was going to happen.

Folks, we have to be wise as serpents but harmless as doves. The harmless part we’ve got down...the wise, not so much.

How can anyone legally use the clerk’s signature against her will? She’s the elected clerk. She could be impeached, but where is the judge’s legal authority to issue anything in the clerk’s name? All religious issues aside, maybe the judge himself should be impeached for exceeding his legal authority.

What would be done to any other government official who refused to carry out their duties? Methinks there’s a legal process that must be followed, and I’m pretty sure no one can legally force her to issue marriage licenses. That won’t necessarily stop the black robed tyrants—they are called that for reason—but legally, there must be certain processes for handling government officials who refuse to perform their official duties. I don’t think those processes include imprisonment btw.
