It’s not hard to fathom. The clerk, whom I admire, really has no case as an individual if Kentucky won’t back her. The state says it’s her job to issue the evil licenses.

They didn’t get four, because the four realized that justice Kennedy will always support the homos. Therefore they would lose, 5-4, *and* establish a court precedent.
By rejecting the case entirely, it is not given a decision, like the vast majority of the 8,000 cases appealed to them each year.
