The 8th amendment ban is against cruel and unusual punishment. Do it regularly and it won’t be cruel and unusual, just cruel.
(I can play with the language just like the anti-2nd amendment folks can.)
You’ll notice that those that side with the criminals never notice how cruel and unusual they are in their crimes against the innocent.
