That puts a different spin on it. If I read the story correctly, the article said:

"Bedgood said that Irvin told the captain that the general had never touched his neck, only his arm."

Now that we have a dispute as to the facts, I will have to rethink my original take on this case.

I think this is going to have to be put in front of a jury.

That does change the situation. Hands on arm, No biggie. Hands on throat, battery in progress. Totally different response.
