Under current law, as it has been interpreted and enforced under the Code of Federal Regulations, yes, they are “subject to the jurisdiction” of the United States. Period.

Again, there is an open question as to whether Congress could clarify the meaning of “subject to the jurisdiction thereof,” and exclude the children of illegals, but Congress has not done so, meaning that, as things stand now, the children of illegals ARE citizens.

I’m not arguing what the law should be (I tend to agree that they should not be citizens, as that is a significant motivator for people to cross the border/fly over here). I’m just saying how things are working, right now.

Interpreted means nothing. I could interpret the laws of murder to mean anything I want especially if never enforced. Interpretation doesn’t make it so.

And it’s not an open question as to whether Congress could do anything...Article I, Section 8 (I believe) give them plenary power of citizen determination.

I do know it doesn’t take a constitutional amendment to address and clarify this. Also, I’ll be cynical and say “so what if it’s the law...laws are broken by our government everyday”.

Just because John Roberts illegally made Obamacare the “law” doesn’t make it so.

To hell with the law. If the left can ignore it then why should be abide by it? Anarchy? It’s already here.
