Jail is were you go after you are arrested to await arraignment. Prison is where the judge assigns you for a specific period of time after trial and guilty verdict.
H should do consecutive terms for each violation amounting to something like the sentence the guy got for the Colorado theater murders.

I have a hard time believing team Barry didn’t know about it. Probably a combo case of go-along-get-along and giving your rival enough rope to hang themselves. You use it when it becomes an advantage.
