Officer Robert Busch also stated that Jim Ochse “became very hostile and began yelling in my face” when he first approached him for singing in front of a crowded restaurant.
Busch also wrote in his report that Ochse remained defiant even after being slammed to the pavement, keeping “his arms so tense that I could not move them or get the handcuffs on the defendant.”
As a result, he charged Ochse with disorderly conduct and resisting arrest, according to The Morning Call.
***** A 61-year-old man happily singing a Beach Boys song in front of a crowded restaurant in Pennsylvania was violently body slammed by a cop before he was carted off to jail Friday.
But Allentown police have yet to tell Jim Ochse what charges he is facing, assuring the self-employed athletic trainer that he will be cited by mail – most likely waiting for the videos to surface before concocting their narrative.
Already, two videos have surfaced, thwarting their initial plan to claim Ochse had touched the officer, which, of course, would given the officer the green light to pound his skull into the pavement.
Instead, the videos show that Ochse was attempting to walk away when the cop grabbed him and slammed him down on the pavement in front of shocked witnesses eating and drinking at Shula’s Steakhouse in downtown Allentown while two security guards in dark suits stood passively watching.
The guards apparently told Louisa Ranis Soos, one of the women who recorded the incident, that Osche had touched the officer. This is how she described the incident after posting her video to

Looks rough but you cant tell what he’s saying to the cop before things went downhill. Too many friggen nut cases and idiots on the loose. In this situation I’ll stand with the cop and thank him for getting this loony off the street.

I’m so torn here. I hate unprovoked police brutality, but this guy is a disgrace. Trouble maker from the word go. Disturbing the peace for these folks at a restaurant trying to enjoy their meal, thinking he’s so “cute.” And when he was talking to the officer, he was waving his hands in his face. These old hippies are a disgrace.
Do I like the body slam by the officer? No, not at all. Even pathetic aging hipsters should not be brutalized.
And to all of you calling all law enforcement “pigs,” you’re a bigger disgrace than this old man. Anarchists, all of you.

It was obvious that the man was a menace to society and HAD to be body slammed, handcuffed and arrested.
And the officer ought to be charged with assault and aettery, but he won’t be.
I hate the beach boys music, could have been worse I suppose.
If it was “Be True To Your School”, I could understand the unease.
Another case of police brutality, pure and simple. This cop makes it bad for other cops, because what he did is unwarranted. What is wrong with cops nowadays? They all have a penchant for showing off their attack skills? A better scenario would have the cop saying “Move along, move along, leave.” End of story. In the old days, if a cop needed to reinforce his message he would pull a billy club and gently nudge the person to leave. This video will ensure Allentown pays the old man some big bucks for wrongful actions against him.

The charges will be dropped, the police will apologize and Ochse will win the lawsuit.
