This isn’t what Trump said at all and if anyone listened to Mark Levin’s show yesterday - Trump was right. They are misreading what the 14th Amendment says and means. All Congress has to do is pass a law - simple as that.
Strawman.
Has Trump suggested Congress getting involved?
Not that I have seen...
14th Amendment and Article 1. The USSC is not God and has no jurisdiction in this matter. Constitution grants PLENARY, i.e. TOTAL jurisdiction for defining naturalization and birthright. The 14 excluded Indians who were born within the USA but whose jurisdiction was to a foreign nation due to the status of tribes as nations having treaties with the United States. That pretty much says that children born to citizens of foreign countries are NOT CITIZENS.
Two things, first off that headline is a disgrace, he did not say that.
As far as the 14th amendment goes, there was no illegal immigration in the 1860s, there was no law about it. So, it was not addressed. The writers did wish to address what happens to the children of foreign ministers and the like who happened to be here and stated they did NOT have citizenship because they were under a foreign government’s control.
If one feels it is moot, than why was a separate law later passed giving native americans citizenship status at birth?
Ask that question to a lib and watch their heads explode.
