There's a Minnesota homeowner currently serving a prison sentence for murder, after shooting two burglars inside his home.

He was laying in wait for them after having been burglarized multiple times.

The state contended it was, for all intents, an execution; so much for the "protecting your home" defense.

Byron Smith is a very evil man.

He did not just shoot two burglars.

He toyed with both of them after he had gutshot them, stopping to get different weapons, and he taped himself having fun with them.

He has no soul.

Totally agree with you, not defending him.

Just putting to rest the consensus on this thread that shooting an intruder in your home gets you off the hook.

He's lucky that his round hit the criminal and not some kid sleeping in bed across the street.

And it's also a slippery slope as well, if you allow firing a weapon in pursuit: how long can you pursue someone, and how far?

Unless you can prove someone was actually in your house, he (or his heirs) can claim that you attacked him on the street, maybe mistaking him for someone else, etc.

Castle doctrine is for castles, and even inside the castle it isn't limitless.

1st rule we heard in the CCL class. Never, ever talk to the police, other than the 911 call. And, keep that simple and direct. No details. 2nd call is to your attorney.

Not sure if i go that far, all i mean is how does the guy know they aren’t running away to regroup and come back at him? I just think that is a stupid automatic assumption that they arent going to come back again once they get safe, and try some pincer type movement or one sneaks around from behind. It has happened to plenty of people. They could have a vehicle with others in it for reinforcements.

He should get neither.

The message sent would be the correct one: (a) if you kill someone in pursuit you should expect some scrutiny, and (b) if you burgle someone, you are risking death and the person who kills you is not risking prison time.

I’m not going to argue with Ayoob. That does seem to be geared towards a shooting out on a street, rather than in your home. But that’s still a good line to remember.
