The judge is saying birthright citizenship can’t be rescinded retroactively. It can be taken away prospectively, though. And many deported illegals would presumably bring their minor children home with them rather than subject them to the foster care system or whatever government institutions care for them.

Exactly.

The concept of jus soli is absurd on its face-which is why most Americans oppose it when it's explained to them, and why most of the planet rejects it.

Even though it contributes only a slight percentage to the number of immigrants in this country, it has horrible cascading policy effects that open borders advocates refuse to acknowledge.

If we were to appoint justices who did not think they were a running Constitutional convention, they would find that Constitutional, as distinguished from statutory, birthright citizenship was never in effect in the first place and that, thus, there would be no “retroactive” change.
