Enquirig Minds Want to Know.

Why was official State Department communications going through Hillary’s private server?

Why was Top Secret State Department communications going through Hillary’s private server?

Why was “Top Secret” stripped from email going through Hillary’s private server?

What did Hillary do with the Top Secret emails once she received it?

The experts say that these Top Secret should have been recognizable to the Secretary of State as requiring handling as Top Secret. If Hillary recognized them as Top Secret why did she not report the mishandling to the proper authorities?

If Hillary did not recognize these emails as Top Secret why didn’t she?

[ “Her Private Server.” Let me reiterate....HER}

She explained to reporters that the server was initially set up for former president Bill Clinton for his home office, adding that it was guarded by the Secret Service and had “numerous safeguards.”

It was Bill’s too, why this is being overlooked is beyond me.

Gross negligence with handling classified material is criminal.

Mark Levin touched on this yesterday. IIRC Levin said intent is not needed for a conviction. Levin contradicts Dershowitz. I will go with Levin’s opinion.

Alan obviously has never had a security clearance. ANY use of classified materials is a responsibility.

That presumably is why she had her aide strip the emails.

But Mark Levin says that she could simply be nabbed with this on the gross negligence of all the emails she had going to her unsecure server in her barn:

Clinton buttboy from wayback Dershowitz recently weighed in on gun control:

“ALL citizens need to be disarmed & the gubmint should start kicking in doors NOW!!!”

Good thing Alan doesn’t have the authority of, say, the little riceball in NK.

Hillary has stated that she set up the server for her convenience as Secretary of State to avoid carrying multiple email devices. (She’s lying, but it’s what she claimed).

Hillary served as SoS for 6 years, and has bragged about the extent of her travel (as a substitute for actual accomplishments).

So Dershowitz would have us believe that Hillary set up her secret system without realizing that a US SoS would receive classified communications constantly? And that in 6 years she never saw a single document on her system and realized it was classified? If she didn’t, she should have. No one is that stupid.

Of course the optics have been rigged by the State Dept’s IG, who chose to review a tiny sample of 40 emails, so that they can now talk about 2 or 4 classified messages, when the actual number is in the thousands. And that is a sample AFTER her minions vacuumed the files of compromising material.

I can’t wait until e-mails surface of the same messages that H turned in as hard-copies, with the Secret labels still on them. Hillary will try to blame her minions, but who told them to do it? Could even Alan Dershowitz pretend that wasn’t a crime?

Not true, lots of stuff are full of current communication without classifications due to urgent needs, so later the proper certifications are placed.
That is why we use government servers and Hillary broke the law in her pride and control freak habits in using her own.

>> not turning that person in also constitutes a felony offense <<

Not necessarily. A conviction for “misprison of a felony” would require the prosecution to prove not only that Hilary knew about the felony, but also that she helped in some way to conceal the felonious act.

On the other hand, the evidentiary requirements for impeachment by the House and conviction by the Senate would not be so strict. The hurdle there would be getting 2/3 of the Senate on-board for a conviction — not at all likely.

He is correct. The question then becomes, since it is Clinton’s private server, someone with access to Hillary’s email has committed a felony and has violated several National Security regulations. Which means that person can and should be tried, convicted and sentenced according to the law.

Isn't part of her responsibility as SoS being able to recognize sensitive information and making sure it gets properly classified and protected?

Someone please explain why she didn’t FEEL the need to use the Government owned computer that was issued to her like all the other Government employees?

Evidently Dershowitz doesn’t know jack about security laws within the federal government.

Yup.

Nor, apparently, is he aware how closely Feds are monitored.

I have a story about that.

hell will freeze over before Hillary (or any Dem for that matter) will face charges for any misconduct in office.
Whereas, simply holding office is a crime for any republican according to the ‘Progressives’.

Hillary Clinton can't be held responsible for forwarding emails through her private server if they weren't marked as being classified, Harvard Law School professor Alan Dershowitz said Thursday ..."

The more I think about, the more ludicrous this statement becomes. The fact she was conducting ANY Fed business on her private server violates MANY laws. Namely, the one that requires you preserve emails where you conduct Fed business. Secondly, you may not host Fed emails on private servers as a security precaution, no matter what the content.

Dershowitz is wayyyyy out to lunch here.

>> lots of stuff are full of current communication without classifications due to urgent needs <<

Not only that:

You never want to give the enemy free access to your unclassified traffic, because even the unclassified stuff will have clues to help the enemy decrypt your classified material. Cryptanalysts have known this truth at least since World War One, maybe much earlier.

(And somebody please correct me if I’m wrong, but I would have thought all government employees who handle national security related traffic are briefed on this principle.)
