Connecticut Supreme Court Rules Death Penalty Unconstitutional

Connecticut's Supreme Court ruled Thursday that the state's current death penalty law is unconstitutional.

The decision spares the lives of 11 inmates already on the state's death row who were subject to execution even though state lawmakers passed legislation repealing capital punishment in 2012. That law applied to all future cases, not capital crimes committed before the legislation was enacted.

The court effectively closed that loophole with a 4-3 vote.

Considering recent cases of police abuse, bad judges, & corrupt prosecuters, I'm okay with life sentences.

That was done on purpose. The law was changed, and exceptions were put in because of the brutal murder in Cheshire a few years back. As soon as it passed, we knew that it wouldn’t pas constitutional muster (equal protection). That was the plan all along.

Connecticut’s legal system is too corrupt to be trusted with the death penalty.
The judges should know that better than anyone since it’s their fault.

Wish I could have just not done the hard parts of my jobs...

I don’t have any strong moral objections to capital punishment, provided we are 100% sure we are hanging the right guy. But in the current climate I don’t trust government with that kind of power. The idea of handing the power of life and death to an entity with the efficiency of the Post Office and the compassion of the IRS is just a bit too scary for me. So yeah, lock em up and throw the key away. Oddly life sentences are usually cheaper than death penalty cases anyways.

And yeah, as noted above, this is a state decision. The people of Connecticut are the ones who need to deal with it.

That’s Connecticutt’s issue. I personally oppose the death penalty because of too many corrupt prosecutors. If anyone deserved it though, it was Joshua Komisarjevsky and Steven Hayes.

I have long held that when guilt is overwhelmingly established, it is wrong to sentence the Tax Payers to life in Prison.

In cases where the evidence is weak, they should provide for a Life Sentence with the provision that it can be upgraded to Death if more evidence is brought forth establishing guilt.

But do not be so quick to sentence tax payers to life in Prison. It is a heavy burden for the contributing members of society to carry.

I've read costs of around $40,000 / year per inmate.

This part I do not. I think in cases where guilt is overwhelmingly established, it serves no one's interest to wait.

This part I detest with a blue purple passion from h3ll! The reason life sentences are cheaper is because of all the bullshit interference thrown up by opponents of the death penalty! They are forcing the costs up through ridiculous litigation that should not be tolerated by a properly functioning court system.

You cannot count the costs of this litigation as a legitimate cost. To bow to this sort of pressure is no different from paying extortion money, which is more or less exactly what it is.

And yeah, as noted above, this is a state decision. The people of Connecticut are the ones who need to deal with it.

The consequence of people deliberately misinterpreting the law will not remain in a locale that is committing this offense. It establishes a precedent for it to occur elsewhere. You let disrespect for the law spread, and it will infect everywhere else too.

Unless Connecticut’s Constitution has language which violates constitutionally enumerated rights, therefore violating Section 1 of the 14th Amendment, I agree.

You really did not understand what I said. I'm fine with the death penalty, but let's be honest, the system is not pure. Lying cops, judges that ignore the law, scumbag defense attorneys and prosecutors looking to make a name for themselves off of cases detract from legitimate trials.

In cases where they caught the dude on tape and he's a guilty as hell, march his ass out back and shoot 'em.
