Curious, I’m sure you have general aviation planes overflying your property.
How do you determine if they are spying and if you should fire on them?

Settle down, little Danny. I’m not addressing what that operator did because there are conflicting stories. Irrespectively, of what you think you know, you are only half right in your assertions of “rights”. The operator should not fly over people and the only building he is allowed to fly over is his client’s house below the height restrictions established by local laws.

Regardless of what you think your "rights" are, you fly your drone over my head or my house without permission and I'm bringing it down.

If this clown was flying his drone commercially without a AC/Section 333 exemption, or a SAC-EC, or a COA, then he's a danger to the community.

Flying for a hobby is one thing, but flying commercially is another matter entirely because the FAA controls commercial UAS, not the local laws.

Clowns like this guy are responsible for the loss of property during a brush fire recently in CA whose flight over the fire grounded the firefighting aircraft and for the near miss of two airliners over JFK.

They weren’t that far away. After all, they showed up rather quickly after the drone crashed.

Modern radio systems have a 2-mile range, so that's a pretty big area to search.

I read the article and found nothing that would convince a jury beyond a reasonable doubt that the drone operator was acting illegal. I did see evidence that would convict the guy who shot down the drone of reckless endangerment, possibly illegal discharge of a firearm, etc.

Second, even if he was a ‘peeping tom’, that does not justify taking the law into your own hands. Call the cops. BTW, you do not own the airspace over your property. Nor do you have an expectation of privacy outside your home, even if it is your privacy fenced backyard.

“It was an $1,800 Drone. What does that tell you?” I haven’t the foggiest. Why don’t you tell me what that tells you?

It’s called property rights, gun rights and a right to privacy. Ever hear of the 2nd and 4th Amendment of the Bill of Rights?

Rights trump, laws, statues, regulations and ordinances period. The are inalienable. Meaning you CANNOT put a lien on Rights with laws, statue, regulation or ordinance. Rights trump everything, but our Creator. This is because we each have right as “Human Beings/Spirits” from our Creator. No person, entity, group, business, government body, etc... can violate it.

As for “air rights” over your property the law is unclear. No one has private ownership to the Air or Seas. Therefore, it falls under Admiralty law.

Anyhow, the drone was clearly spying on his daughters. You ever heard of “Stalking” laws?

You would be correct if these girls were in a public park, beach, etc.... However, when you are on private property the rules change. No one can come in there and VIOLATE your right to privacy. When people violate you or your family. Certainly peeping Toms/perverts, etc... Not only do you have a Right to defend your family, but it’s your duty to defend it.

So I don’t know where you come across about taking the law into your own hands. The ONLY PEOPLE guilty of that is the pervert drone operator. Humans DO NOT HAVE THE RIGHT to VIOLATE other human beings. Certainly little children.

For the record, the cops are not their to SERVER FIRST and then come to protect if needed. If they are at a hot scene then yes, but if they have to come to where you are at. Which they do most of the time. They are not LEGALLY LIABLE if anything happens to you or your family while you were waiting for them. .... So in other words you are on your own........... if you are being assaulted. The police are there first, to investigate what happened. Now if its still going live, then yes they can defend you at that point. However, if it’s over, then there is nothing you can do about it.

No, Chief. Let me type slowly and spell out some "gun stuff" for ya. You can lawfully use deadly force for protection where your life and family's lives are threatened. (You and I can both agree that we'll do that, no matter what ordinances, laws, etc say.) You CANNOT lawfully randomly shoot aerial vehicles down just because you "think" you or your daughter are being spied upon. The shooter is being charged and your and his facts about the law in this matter are wrong.
