City Orders Man to Keep the Smell of BBQ from Leaving his Property

on July 22, Joe Graham from Air Compliance is writing a complaint form for “objectionable odor” from Jordan’s property where he was barbecuing. A neighbor living across the street called to complain, as she has apparently done many times before.

This time she found a willing co-conspirator.

“I can smell it again right now, but I’m on your property,” Graham tells the group. “You’re allowed to have it smell on your property, so that doesn’t count, but when I’m on the street, that’s when it counts.”

“So we’re supposed to control the smoke and the wind and where it’s blowing it?” he asks.

The Environmental Specialist says, “What you’re doing looks like it may be counter to the rule as far as the objectionable odor,” as he looks at his clipboard for reassurance.

“You have smoke leaving…that’s prohibited. I saw smoke leaving your property.” So he’s going to “write it up and send it to our department.”

The ridiculous nature of this visit results from the fact that in Pinellas County, “Commercial barbecue cookers are not exempt from causing a nuisance odor,”. It is part of a larger set of rules regarding air quality, normally reserved for things like asbestos and trash burning.

However, Mr. Jordan should have nothing to fear. The Frequently Asked Questions goes further to state, “If a sufficient number of complaints, representing different households, are reported and an Inspector witnesses the problem, they can issue a Warning Letter.”

According to this, he could not get a Warning Letter unless more than one neighbor complained. And this is unlikely to happen, since, according to Jordan, “Everybody else cooks out around here.”

The cameraman says, “We’ve been living here for 40 years, and this is the first time this happened.”

He is referring to the visit from Air Compliance. Since the neighbor moved in three years ago and began complaining, she has called the police and fire departments. “They tell me to go ahead on” and keep barbecuing, according to Jordan.

Graham has an answer for this too. “The police and the fire department are looking at different parts of the rule.”

And so continues the endless splitting of hairs, red herrings, and absence of common sense that characterizes nanny state bureaucracies

And in 2006, people probably laughed at the notion that outdoor BBQ would be banned because some old hag across the street might object to the smoke. (However, I think there's something more at work here. Perhaps she doesn't like the fact there are black people in her neighborhood).

Just like back in 1974, it would have sounded crazy if somebody offered that soon children would be prohibited from riding bicycles without crash helmets. Or that bakeries would get shut down for refusing to bake a homosexual cake.

Nanny government is incremental and if left unchecked, will eventually come to dominate every aspect of private life.

Expect more and more of these “nuisance” reports as vegetarians and vegans increase in numbers. Obviously, everybody now cooking out is probably cooking meat. I trust vegans and liberal water carriers to stop at nothing to try and stop people from eating meat.

Invite her over to talk about the incident and give her a plate of bbq fresh off the grill. The second she touches the plate, she’s accepting of him grilling. Case closed.

There are Laws and regulations like this in the books all across the country and
are not being enforced. They are placed for that day when statists "not used lightly"
can crawl out of their slime and enforce them all to create utopian bliss. Block captains
and snitches to get their neighbors arrested.

Sometimes they'll crawl out to test these laws like in this case, to see if America
has been dumbed down enough to fall for the communist entrapment that ends our freedoms.

To comply with these regulations and laws is to give in to the Government and
hand over our freedoms without a whimper.

How long does your BBQ remain on when you’re cooking up a batch? One hour max?

Slow and low is the way to go... I can leave ribs on for 4 hours easily.

I think we need to to an online fund account to buy this man a professional smoker so he can keep it going 24-7.

There’s also overnight smoking too. You’re right. I realized after I posted I had given too little time when I set the peg at an hour.

I was thinking more of the conventional burgers, hot dogs, and steaks on the outside grill, rather than basted and long cooked items.

Good point.

I’m too nice to spread large amounts of fresh manure on whatever flowers are closest to the obnoxious neighbor in response to this sort of harassment. Probably. But I do not approve of whining to regulators over trivial issues.
