City Orders Man to Keep the Smell of BBQ from Leaving his Property

on July 22, Joe Graham from Air Compliance is writing a complaint form for “objectionable odor” from Jordan’s property where he was barbecuing. A neighbor living across the street called to complain, as she has apparently done many times before.

This time she found a willing co-conspirator.

“I can smell it again right now, but I’m on your property,” Graham tells the group. “You’re allowed to have it smell on your property, so that doesn’t count, but when I’m on the street, that’s when it counts.”

“So we’re supposed to control the smoke and the wind and where it’s blowing it?” he asks.

The Environmental Specialist says, “What you’re doing looks like it may be counter to the rule as far as the objectionable odor,” as he looks at his clipboard for reassurance.

“You have smoke leaving…that’s prohibited. I saw smoke leaving your property.” So he’s going to “write it up and send it to our department.”

The ridiculous nature of this visit results from the fact that in Pinellas County, “Commercial barbecue cookers are not exempt from causing a nuisance odor,”. It is part of a larger set of rules regarding air quality, normally reserved for things like asbestos and trash burning.

However, Mr. Jordan should have nothing to fear. The Frequently Asked Questions goes further to state, “If a sufficient number of complaints, representing different households, are reported and an Inspector witnesses the problem, they can issue a Warning Letter.”

According to this, he could not get a Warning Letter unless more than one neighbor complained. And this is unlikely to happen, since, according to Jordan, “Everybody else cooks out around here.”

The cameraman says, “We’ve been living here for 40 years, and this is the first time this happened.”

He is referring to the visit from Air Compliance. Since the neighbor moved in three years ago and began complaining, she has called the police and fire departments. “They tell me to go ahead on” and keep barbecuing, according to Jordan.

Graham has an answer for this too. “The police and the fire department are looking at different parts of the rule.”

And so continues the endless splitting of hairs, red herrings, and absence of common sense that characterizes nanny state bureaucracies

you obviously dont BBQ. You grill. A long BBQ takes 24 hours. It does stink (make your salivary glands leak) up the entire neighborhood, but I luckily have great neighbors. It makes them hungry. They yell out what are you cooking this time. I say, it is a surprise. Ill bring some over when it is done.

Never a complaint. Not even when I said don’t eat this. I got a creosote film on it. It is nasty.

Go figure. No “homo” home owners association. My wife saw to that. ;-) (Elected with her group and disbanded it. who cares if you have your boat stored in your driveway unless you are a sh!tstain lib. Mind your own!!!)

Yes, you’re right. I don’t do the long slow cook like you folks do. I realized after I posted that I was going to catch some flack.

Thanks for your post. I should have been challenged so folks would know what the long cook times would be like.

No flack from me. I grill on the webber. I sear steak till it quits mooing on the ausie grill (my poor wife hates it when I bring in raw just seared steak, but I love it). I smoke on my egg. Its all good. Everything from each one of them makes people salivate. Make sure you use hardwood lump no matter what. The anthracite in kingsford sucks. If you choose briquettes make sure it is labeled 100% natural. No nasty petrochemicals then. Petro is great, just not for food.

A treat for you since you like it quick: Use your leaf blower to get a hardwood lump fire blazing hot. Throw skirt steak directly on the coals for 60 seconds. Turn it. 60 seconds more. Done. Best fajitas you will ever taste, bar none. The leaf blower means no ash to speak of. The flavor is absolutely divine. After you pull it off, foil it well and leave it for 5 minutes to finish unless you like your meat like I do. A good vet can get my steak back on its feet in a cpl of hrs. ;-)

It’s just me these days. I don’t grill anymore. The last one on the way out took the BBQ. I may replace it some day. couple of more years may change me enough to stomach it.

I appreciate the tips. I read it good and hope to remember it when the time comes.

We warned the smoke-gnatzies, they scoffed at our warnings. The left welcomes the tools provided to them by some FReepers that were willing to allow the usurpation of private property rights by banning tobacco use where it caused a nuisance smell.

Is that available to anyone? I could certainly use some for applications around my own home. Seriously, it seams that I am always appying weed killer to a stone pattern patio that I have and it drives me nuts!

This worked well for me to kill weeds between patio stones:

1 gallon of vinegar with one pound of table salt added. Shake and dissolve salt into solution and pour on or put in a sprayer.

It sure has to be a lot cheaper than the standard weed killers, but how long does it last for you? Where are you located? (just to estimate your growing season.)

Of course, it won't apply to marijuana smoke.

The smell from legal activity must be stopped, but the smell from illegal activity is okay.

I was having a hard time remembering his name, because Arnold flashed into my mind, and of course Schwarzenegger’s first name is Arnold. I was questioning my first impression on the name.

Pramitol is available over the counter at places like Tractor Supply or Rural King.I think that Atrazine requires an applicators licence,but you really don’t want that toxic stuff around the house anyway.
