I gave you the resources and there are multiple laws within each code that confirm this was a lawful order.

If you’re too lazy to read it yourself then you should stop posting as if you actually know the law because your own admission to not reading the law, proves that you don’t know the law. I have no dog in this fight, but I’m trying to educate you.

If she had kept her mouth shut she might still be alive. There are bad apples in every occupation. I have an EX-son-in-law who is a hothead cop with a hair trigger temper and is the last person who should be running around loose with a gun. However, kids today do seem to have a greater tendency to run their mouth at any one in any position of authority. Not a good idea.

She violently resisted arrest. She was given only a warning for the traffic violation.

She was in jail for 3 days because none of her family or friends cared enough about her to put up $500 (10% of $5,000 bail) to bail her out.

I heard this on the radio this morning. While it was stupid to make a lit cigarette be the “hill you die on” with a cop, it got me thinking: what right DOES a cop have to tell me to put out a cigarette in my own car? For a traffic stop no less.

It might be a reasonable request if the subject was asked to step out of the car first, on suspicion of some other, more grave offense, and THEN ordered to put the cigarette out. But during a traffic stop? Suck it up Officer Friendly, you’re the one who pulled me over remember?

Yes, it is considered a lawful order because it does not violate any civil rights or TX law. It is commonly done for officer safety or for investigative reasons.

A police officer ordering you out of your car is a lawful order that you are required to comply with. You can argue about whether it was justified and sue later, but you must comply.

A police officer can also require that you get out of your car for any reason. Again, this can be for officer safety or for investigative reasons. A lot of cops do it so that they are not in traffic.

Her hostility may have triggered a red flag. Plus he probably knew from dispatch that she had previous drug ( including MJ) and alcohol arrests. Her attitude and her history probably made the cop suspicious so he decided her ask her additional questions. He asked her to put the cigarette out so she didn’t try to burn him with it due to hostility or because he was attempting to smell drugs or alcohol. Cigarette smoke is commonly used to mask the other smells. She was already legally detained for the traffic stop.

Red Flag? He asked her a question she answered it and it made him angry. Apparently truth is frowned upon by this guy. He got testy and told her to put out her ciggy when she was signing the form. The encounter was over he was done. Anyone with two eyes can see he was being petty and trying to provoke a response so he could escalate.

Cops a jerk. Should never be in law enforcement.

Woman could have defused the whole thing by just being cooperative and polite.

People behaving badly. It’s an epidemic in our messed up society, and nothing good comes of it.

I can’t prove a negative. If it is a lawful order, it will be easy to find. If it isn’t a lawful order, it will be impossible to find.

You are asserting the positive position, so it is your responsibility to prove it. I can’t prove a negative.

It’s like me saying “If you don’t beat your wife, prove it.” No, in that case the burden would be upon me to prove you are beating your wife.

You say you know it is a lawful order. Prove it. Link the location in the penal code.

Like I said, his attitude may be bad policy, but isn’t illegal. I’m not defending his attitude one way or the other. However, her refusals are illegal. Besides, neither of us were there. I’m just educating you as to the possibilities of why he asked her to put the cigarette out. He may not have had any red flags or he may have gotten a red flag at the last minute. Since it is not permissible for cops to narrate on video cam, he didn’t verbalize his reasoning.

You automatically assume he didn’t have cause, but you don’t know that. I gave you several possible scenarios. Maybe he thought he smelled MJ at the last minute since she had previous arrests for it and was coming from out of state. Maybe she just lit it up while he was in the car so he didn’t have a reason to ask her to put it out previously. You don’t know. You just want to attack the cop without the facts. Regardless, he gave her a legal, lawful order and she illegally chose not to follow it. She was still in the wrong.

Oh really? Then why did he resign? His overall behavior, as captured on video, would lead any reasonable person to believe he was ill-suited to be trusted with a firearm. He was like a bull in a china shop! As for the “arrest,” this a$$hole couldn’t even handle a 14 year old child!
Like the “mexican cop” in this situation, its all about “his authoritah!” A woman is dead for not using her turn signal! I guess you are o.k. with that!

He did not have the authority to order her to put out her cigarette. Without that authority, he did not have the authority to remove her from the vehicle for refusing his order. Without that authority, he did not have the authority to physically remove her or threaten her with the taser.

No, it obviously and apparently was not over, and he was not done. He was still standing at her window and interviewing her. He most certainly had not sent her on her way with a “Have a nice day, Ma’am”, did he?

Just because you say it was over and he was done doesn’t mean it was.
