That topic was brought up. If the president federalizes the Arkansas National Guard troops, the director of the Arkansas State police can deputize National Guard members as well as Sheriffs of their respective counties.

I'm surely no expert on such matters but it's always been my understanding that while Governors have *some* degree of command authority over Army and Air National Guardsmen the President,as CiC,maintains ultimate command authority.If I'm correct on this it would take nothing but a phone call to summon the commanding officers of the Arkansas Guard to DC and issue them a direct order.

It's just a question of whether Obola would want to make a "Federal case" (no pun intended) of this.Which,I'd wager,he would.

The National Defense Authorization Act 2008 Pub.L. 110-181 Repeals provisions in section 1076 in Pub.L. 109-364 but still enables the President to call up the National Guard of the United States for active federal military service during Congressionally sanctioned national emergency or war.

If I'm reading that right (and I hope I am), the President cannot federalize the National Guard without the approval of Congress.
