Good question. The accused has the right to confront the accuser in court, to attempt to challenge or impeach their testimony. Unless the testimony is presented in court, that can’t happen, and we will never know if the testimony would hold up to any challenges, so its evidentiary value is going to be questionable.

The court date was in 2006, when Cosby settled with a victim of his drugging/rape.
The new revelations and incriminating evidence are coming from Cosby’s testimony and evasions, from that trial.
