I see. Sort of like being present when the Kenyan was sworn in. Any injuries or crimes committed following this would be the crime upon which hinges the charge of conspiracy. Did I get it? See, I could have been a lawyer!

Well the funny thing about conspiracy is this, even if there wasn't a rumble, the crime of conspiracy attaches, if there was agreement beforehand to perpetrate assault (or worse). If the conspiracy accusation is good (it isn't), then the 177 could have been arrested even if there hadn't been a parking-lot altercation, let alone a shootout.

There is no need for the conspiracy to have been carried out, in order for conspiracy charges to attach. But, the authorities are supposed to have, you know, actual evidence of the crime before they arrest a person for committing it.
