Commentators have missed the real significance of Justice Antonin Scalia’s dissent in the gay marriage case. He calls the decision a judicial “Putsch,” an attempt to overthrow a form of government—ours. His dissent, joined by Justice Clarence Thomas, was written “to call attention to this Court’s threat to American democracy.”

Scalia understands the power and meaning of words and he chose the word “putsch” for a specific purpose.

Hence, Scalia is saying this was not only a blatant power grab and the creation of a “right” that does not exist, but a decision that depends on public ignorance about what is really taking place. It is our system of checks and balances and self-rule that has been undermined, he says.

In that sense, he is warning us that we need to understand the real significance of this decision, and go beyond all the commentators talking about “marriage equality” and “equal rights” for homosexuals. In effect, he is saying that the decision is really not about gay rights, but about the future of our constitutional republic, and the ability of the people to govern themselves rather than be governed by an elite panel making up laws and rights as they go.

Take a look around at the American public, and tell me that this issue is going to get addressed in any meaningful way....How ? There’s no longer any real understanding of the constitution; especially in people under 35.

Congress could fix this by simply passing a law stating that no issue on the constitutionality of any state or federal law may be heard by any court other than the Supreme Court and that the Supreme Court cannot overturn any state or federal statute on constitutional grounds unless 7 of the 9 justices concur.

Congress has the power to reign in the courts. They just won’t use it. Most likely because they really don’t want to have to deal with these issues themselves. The Supreme Court gives these weasels cover.

I don’t know... everyone I know is happy beyond words that the gay marriage has been upheld on a National level. One of my coworkers suggested that June 26th be a national holiday! I kid you not! I am frightened for my country...

Two thirds of Americans are utterly insane. The have lost their way into games and playtime like little children and have no idea that they soon will be slaves to a communists empire. When the shi! hits the fan they will go numb and violent because of this lack of understanding how they got there. They will blame everything but themselves. Violence will their only escape.

The author of this piece should have made at least one substantive suggestion as to how to fix the problem. Had he suggested an Article V Convention, I would have pinged the list. But beyond rhetoric and outrage, there’s not much substance here.

First of all, Congress does not have to pass a law. The words in Article III are, "with such exceptions, and under such regulations as the Congress shall make". Regulations and exceptions AS THE CONGRESS SHALL MAKE, not "pursuant to law".

Congress' power here is plenary, it does not require a Presidential signature, and a Presidential veto is not permitted.

Secondly, I'm sure you are right that Congress lacks the balls to do this.

But, if it were to be done, I would favor a narrow regulation barring appeals pertaining to State marriage laws, at least at first.

Sen. Cruz at least laid it out in his National Review article whose FR thread is now up to 261 replies. He laid it on the table:

Either Congress reins in the Judiciary, or the states will assemble in convention and do it for them.

IOW voting alone cannot cure what ails our former republic.
