State wants 2 trials for officers charged in Gray case

BALTIMORE (AP) -- Baltimore State's Attorney Marilyn Mosby wants a judge to order a separate trial for two of the six officers charged in the death of Freddie Gray.

In a motion filed Friday, Mosby asked a judge to allow two officers, William Porter and Lt. Brian Rice, to be tried separately from the four others.

Porter and Rice are each charged with reckless endangerment, misconduct in office, second-degree assault and manslaughter, which is a felony.

Mosby's motion does not explain her strategy for trying Porter and Rice separately from the others.

Sgt. Alicia White faces the same charges as Porter and Rice, as does Caesar Goodson, who also faces a "depraved-heart" murder charge. Officers Garrett Miller and Edward Nero face only misdemeanors.

If the judge agrees, and they proceed on case one to lose it....what does it say about case two and the implications of a lost episode in case one?

I’m not sure I’d want to be a prosecutor going into case two and having seen case one lost. I’d probably just resign and walk away because there’s no way of a win.

I can see two reaons for asking for this.

1, she gets two trials going at the same time with different judges, (hoping to get a liberal judge for the second trial and a conviction or plea bargain).

2, By splitting up the defendents she can offer immunity for the two defendents in order to lie about the facts against the other four.

The defense would be stupid to accept this since if even one defendent is considered by the jury to have been overcharged or not responsible for Gray’s death the likelyhood of the others getting acquitted is higher, (or at least a low misdemeanor conviction for them.

I agree with you 100%. Her case is so bad that she is trying to force some of them to turn on the others to create a case.

The problem with offering immunity for a case is that the community there is already building a gallows for six. Legally, the testimony of officers offered immunity will be heavily tainted. She must think their cases are exceptionally weak.

Well. At least she’s doing the politically balanced thing, picking one white and one black officer. The initial charges were going to be murder—involuntary manslaughter is definitely an improvement. I wonder if the other group will be charged with higher or lower offenses.

Who believes this excuse for a prosecutor would even have the brainpower to think that up by herself.

Mosby is being coached....sounds like something the conniving Clintons would do to save their political behinds.

Baltimore Dems throwing Hillary a much-needed bone, I guess.

Mosby’s got her own ambitions....she’s clearly running for higher office.

God help us.

She is picking the least culpable (if any truly are) in the LT. who most likely was just the detail commander on paper....

And.....

a younger newer (3 years on force) who they may be able to pressure.
