You are presuming that, between the election and the inauguration, Ginsburg will resign, Obama will name a replacement...and a GOP Senate will approve.
Not. Gonna. Happen.
In fact, if Ginsburg should keel over tomorrow, it's highly unlikely that an Obama appointee would be approved before the next inauguration.
