Hundreds attend town hall meeting to discuss BLM's plan for closures of public land ( Colorado )

Grand Junction, COLO. It's a hot debate that's sparked a lot of controversy in Mesa County. The updating of the Resource Management Plan has been in the works for years. It was announced a few months back, but not everyone's happy about the proposal.

The Mesa County Commissioners and the Bureau of Land Management took turns speaking at the town hall meeting. The public listened to what happened in a meeting with representatives from the governor's office, in regards to the Resource Management Plan, and had the chance to share their concerns and suggestions.

At last week's meeting with the governor's office, there were 393 miles of routes in dispute. "After that meeting, the BLM office made us an offer to defer roughly 207 miles of routes," said Mesa County Commissioner Rose Pugliese.

The county had originally asked for a six month extension to analyze the road closures. “I think in the negotiations with BLM, this is probably the best we're going to be able to do to buy us the time that we need as a community to articulate why those routes need to remain open,” said Pugliese.

One of the patriots there, standing against the BLM was someone with Native heritage who suggested he would not allow the FedGov to push him on to the reservation a second time.

No, the began talking about how great it was that they were doing such a great job managing the King's land, and that we should be happy about the progress made (so far, the County has been successful in stopping around 300 miles from being closed, leaving around 1400 miles in limbo...). The response from the audience was laughter and lots of "boos".

Did anyone talk about RS 2477 ? A simple and straightforward law. It is a right-of-way across public lands and not just for roads.

2. Congress specifically and clearly reaffirmed the validity and intent of RS 2477 in 1976. Because RS 2477 became law in 1866, anti-access extremists argue that it is now somehow inconsistent with modern public land management policy. Congress explicitly reaffirmed all RS 2477 grants previously made.

3. Congress specifically by-passed the Executive Branch of the Federal Government in making RS 2477 grants. Under our Constitution, Congress has the exclusive power to manage and dispose of public lands and property (Article IV, Section 3 ).

4. The RS 2477 right-of-way grant is a property right. Therefore, it enjoys the same constitutional and legal protections as any other property. Legally, when the grant was made, the federal government’s interest in the land underlying the right-of-way became the “servient estate” and the interest of the right-of-way grantee became the “dominant estate.”

11. No federal agency has the authority to close an RS 2477 road for any reason, period.

We just got Delphi’d at last weekend’s Planning Board Meeting. The Town Supervisor shot himself in the foot when he responded to citizens’ concerns with “This deal is going through,” mention of alignment with coming Federal
Regulations on roadways, and with reference to “the developer.”

I did have a bit of fun discussing the Delphi method with my discussion group neighbors.

It was certainly mentioned by a few folks, including the BLM Rep, who stated this was NOT the time to discuss RS 2477 (of course, those of us in the know disagreed and suggested it was THE time to discuss RS 2477). Unfortunately, the Fed's position is simple: We know about RS 2477, and we're going to ignore it. If you don't like that, the County can sue us.

Well, the issue is that the County is questioning whether or not they have the resources to sue the Feds over this, and the Feds know this. The County is stating that they are not taking lawsuits off the table, but are focusing on keeping that need from becoming reality in the first place.

RS 2477 has been the cornerstone of efforts by the Public Lands Access Association (PLAA). Brandon Siegfried and the crew @ PLAA was there in force, and did a great job of bringing these issues up.

There was someone there from one of the offroad groups - I’m not sure which one. But the fact is, the off road groups are actually siding, in most cases, with BLM, because BLM is promising all these “new trails” will be opened, and the idiots actually believe them. The offroad issue also brings up another interesting fact: Fees for registering offraod vehicles are going from the State to the Feds, and are being used to implement these BLM “management plans”. It’s really quite the racket.

Like 0bama, the lefty infected BLM and USFS have given up any pretense of objectivity as they have for 40 or more years and are blatantly closing public lands. Both agencies should be shut down and the lands turned over to the states.

The hundreds will just sit there politely like good ‘citizens’.
They ought to be dragging the tax leaches out and roughing them up.

A couple of years ago there was a public meeting about Arizona and Utah "sharing" water with Nevada. It was similar to the "two wolves and a sheep discussing what to have for dinner", only it was "one grizzly" (Nevada) doing the same with two sheep.

I hectored that group about who was sponsoring the meeting and what they would get from it, and other disputations of their "global warming" as a justification for the grab of our water rights.

There were about 50 people there and NOT ONE DAMNED ONE OF THEM backed me up. I looked around, into their faces, and discovered the meaning of "bovine intelligence".

The meeting broke up with no resolution and I had a local reporter ask my name as I had "brought up some good questions". Nothing ever showed up in the paper.

At this point in history, I am looking out for me and mine - and devil take the hindmost. As others have mentioned, this country has had it. The only people I see raising Hell are some of those on this board - and folks - we aren't that many.

And please don't give me the "cut and run" bullshit that usually pops up after one of these "I've had it screeds". You are pissing in the wind if you think you can make a difference.

If I’m not mistaken, RS2477 was watered down during the Sagebrush Rebellion. I believe that it became necessary to assert RS2477 rights prior to some fixed date. Again, I may be mistaken, it’s been a few years since I was heavily involved in this. It seems that they are back to their old tricks and trying to accelerate the closure of roads like they did during Clinton’s term.
