If the other driver had insurance with the same company as you do you will both likely be assessed partial blame by the insurance company so they can raise your rate and his ,, if he has insurance with a different company then the companies will make sure that the right party is blamed. Without insurance the only way for the insurer to recoup any money is to blame the insured party and raise their rates.
We have about a 30% no license/no insurance rate here in Florida (illegals) and my neighbor was in a 4 car chain with the rear car (a truck) being driven by an illegal ,, all 3 other cars were Geico insured ... Geico got nailed with 3 cars and 2 injuries and nobody to subrogate to as the illegal was ticketed and released ,, and you just know he gave the officer his correct name and address when he failed to produce a license...
