"What's that?" you ask, well you know how Congress can set up an agency like, say, the NSA and then give them some sort of power to do things on their own? Like, say, institute a system of domestic espionage and then, when it comes to light wring their hands and complain about how powerless they are? Yeah, like that.
In this case, they've done it before: when CA's Prop 8 came up they essentially said that the CA Supreme court could not certify the standing of its citizens and refused to hear the case — keep in mind that a single federal judge stopped Prop 8. So, by refusing to hear the issues, they were in fact saying (a) that the people had no recourse, and (b) that the state's own will was absolutely subservient to the federal government.
That, my friends, is how to pull a Congress.

If the SCOTUS tries to force gay marriage on all 57 states the answer is the 10th Ammendment. Just say no.
