Actually as a small business that is probably not really the case. If they are a type 'S', that's especially.

Yeah Uh huh...

The reasons lawyers make so much money are because of assumptions like you posted.

Lawyers will sue anyone they think has money. They bend and finesse the law to make their case. NOTHING about our legal system is set in stone ESPECIALLY civil suites...

This penalty is reportedly to be paid by both business and personal assets. I don't know how that works, but they stand to lose their business, their home, their savings, everything.

The old woman being sued in Washington state was being sued as both a person and business, by both men she refused service to AND the state.
They were threatening to take all of her personal assets as well as the business.
The state offered to settle for a few thousand dollars as long as she agrees to give service - and she refused the offer. The issue wasn’t money to them but principle.
