Petraeus sentenced to 2 years' probation for military leak

Former CIA Director David Petraeus, whose career was destroyed by an extramarital affair with his biographer, was sentenced Thursday to two years' probation and fined $100,000 for giving her classified material while she was working on the book.

The sentencing came two months after he agreed to plead guilty to a federal misdemeanor count of unauthorized removal and retention of classified material.

The plea agreement carried a possible sentence of up to a year in prison. In court papers, prosecutors recommended two years' probation and a $40,000 fine. But Judge David Kessler increased the fine to "reflect seriousness of the offense." He said Petraeus committed a "grave and uncharacteristic error in judgment." Appearing calm and wearing a business suit, Petraeus made a brief statement before he was sentenced, apologizing "for the pain my actions have caused."

Petraeus attorney Jake Sussman said this was not a case about the public dissemination of classified information, but the wrongful removal of materials. But prosecutor James Melindres said, "This is a serious criminal offense. He was entrusted with the nation's most classified secrets. The defendant betrayed that trust". Melindres says Petraeus compounded that trust by "lying to the FBI."

In a brief statement after the hearing, Petraeus said this marks the end of a two-and-a-half year ordeal, and he just wants to move on. "I now look forward to moving on to the next phase of my life," he said, before walking to a waiting car and leaving. The agreement was filed in federal court in Charlotte, the city where Paula Broadwell, the general's biographer and former lover, lives with her husband and children.

However, he was not in the military at the time, so what any military member would have done is irrelevant. He was the director of the CIA...a civilian position. He retired from the Army on Aug 11, 2011 and took the CIA job on Sep 6, 2011. The Army regs did not apply to him after he retired.

Actually, you are wrong. As a retiree entitled to pay he IS subject to the Uniform Code of Military Justice, and he was subject to it on 06 Sep 2011 the same as he was 10 August 2011.

Pay particular attention to this part:

Retired members of a regular component of the armed forces who are entitled to pay.

So it does matter what would happen to others as there is supposed to be an equal application of the Code the same as there is for other laws. Likely an E-4 or some nobody 0-4 that was found guilty of such would probably also be subject to forfeiture of all pay and allowances - whether Active or retired (though these days, most likely a retired E-4 would probably be a medical retirement).

Who did the setting up? Who would gain the most if Petraeus keeps his mouth shut about Benghazi? Answer the second question and you know the answer to the first.

What I want to know is why did the military allow the fat Lebanese so-called socialite to have free access to CENTCOM? If you or I were to go down to CENTCOM and try to get in there we’d be turned away immediately. Yet the middle eastern gal was waved in and socialized daily with the brass. How did that happen?

This is one reason I was looking at Google to see if there was any obvious connection between the Lebanese sisters and Grover Norquist with his Palestinian wife. While I did not find anything obvious I only looked a short time. I did find that the family of Norquist’s wife are Palestinian rights activists and connected with various related groups. Must do more searching.

This may be a case of over analysis...
Regardless of what the motives might have been, the Sh!tbird didn’t have the guts to step up to the wife and say the marriage was over before he fooled around, subjecting his wife to being infected with a possible STD let alone lying to her, their kids, his boss and the country he served...
No excuses, no need to dwell on it...it is what it is...

No worries. I wasn't trying to be abrasive; re-reading my post it could be perceived as such.

The "man can't get me once I'm out," is a dangerous misconception some folks have.

I know a guy that was threatened with losing his pension over a mistake in paperwork because he misread it....even though when they asked him about it he told them everything freely. He didn't realize his folly until they showed him the "fraudulent" paperwork. One form out of 20 and he answered one question "falsely" because it was worded slightly different from all the rest.

His GF did not have an active security clearance or the damn need to know. The General should be doing time for this period. If I disclosed classified info to my GF regardles of wherter or not she disclosed it, I would lose my clearance, my job, be fined, and go to jail. The General signed the same damn non-discloser agreement I did. He needs to be treated the same as anyone else who broke that trust. His military and tactical prowess do not put him above the law!

Centcom has a residential section too. They don’t have a lot of planes any more for an air force base but it’s international. Lots of countries are at MacDill. Jill Kelley could easily get through if she even knew one person who lived on the base in a house.

Character, integrity, honesty, and loyalty aren’t based on looks, brother.

He made a vow. An Oath. Several actually; one to his wife, another to his Country.

In a graceless age, I know those words seem old-fashioned and out of date... but to people with character, integrity, honesty, and loyalty, they still matter.

We’re all fallible, ultimately; it’s how you react to it that matters.

Petreaus was out of line, completely. For the record, your comment regarding his wife was too.

You are right and I am wrong. I said that other than firemen and honest policemen there have been no American heroes since Abraham Lincoln.

The millions of Americans who’ve fought and/or died in battle (Thank you, Seals, Marines, Soldiers, Airmen and Sailors) are heroes; as well as the millions of unsung who’ve risked their lives intervening or saving beleaguered family members or strangers.

And there is the category of hero for those who simply live up to and thus defend Absolute Values as opposed to propagating a moral-free America.

My comment was said in the heat of disappointment in Patraeus, whom I had considered a hero.
