During Fogerty’s first comeback in 1985 his old Creedence record company sued him (Fantasy, Inc. v. Fogerty) claiming that “The Old Man Down The Road” shared the same chorus as “Run Through the Jungle” (a Creedence song which Fantasy Records had owned the publishing rights to). Fogerty ultimately won the case when he proved that the two songs were wholly distinct compositions. It’s a fascinating case where Fogerty argued that while his songs encompassed his unique “style” that an artist couldn’t steal from one’s self. Fogerty then countersued for the massive attorney fees that were racked up in the proceedings (Fogerty v. Fantasy). This led to even more lawyer paydays after losing in the Ninth Circuit Court of Appeals (where else?), but ultimately Fogerty won his case in the U.S. Supreme Court, which ruled that a trial court has discretion in awarding fees to defendants or plaintiffs. It was actually ground-breaking stuff that law students are required to study.

Every composer has favorite things that come up more than once in their music. I noticed this even as a child listening to several shows by Rogers and Hammerstein, and Gilbert & Sullivan. Certain intervals, rhythms, phrases, etc show up in more than one instance.
I have certain chord progressions that I really like (the 6m to the 4 chord) but I have to be very careful I don’t overuse them.
Of course, if I vary it too much, the rest of the band has trouble following me! LOL!

Barry McGuire: Cloudy Summer Afternoon
I posted this last night, but it deserves a closer listening.
What made Lou Adler and his label, Dunhill Records, so special was his ability to think outside the box. He took four singers down on their luck, got them to work counterpoint and tight harmony, backed them with the Wrecking Crew, and created The Mamas & the Papas.
Barry McGuire had made a splash with Phil Sloans song Eve of Destruction in 1965 for Dunhill. (I covered Sloans songbook a few years ago.) McGuire had been lead singer with The New Christy Minstrels, and he was classified as a folk and protest singer, which was good for the short run, but not for a longer career. Adler gave him something completely different and backed him with a Dixieland band with roots in the pre-war era. This was released in the summer of 1966 and sold moderately well, but not well enough. McGuire today is a curiosity doing folk revival concerts.
The song was written by Travis Edmondsen of the folk duo Bud & Travis.
From the opening, you sense that this is something different with that Dixieland swing. McGuires vocal is understated, and in the middle the Dixieland band becomes the star of this recording. It takes flight, and youre a bit disappointed when his voice comes in. The band takes over at the end. This should have opened up a new avenue for Barry, but it didnt.
